الملخص
يدرس هذا البحث مظاهر تأثير المواءمة التشريعية في الدراسات الفقهية والقضائية، ويهدف إلى تحديد المقصود بالمواءمة التشريعية وبيان أهميتها، وإلى التأكيد على ضرورة التواصل بين الدراسات النظرية والتطبيق التشريعي، كما يهدف إلى بيان أثر المواءمة التشريعية في الدراسات الفقهية والقضائية، مع الإشارة إلى الأثر العكسي؛ وذلك ببيان دور الدراسات النظرية والنقدية في تفعيل المواءمة، ومن أهم نتائج البحث أنّ المواءمة التشريعية تتأثر بالدراسات الفقهية والقضائية في كونها تعرّف بعناصرها ودوافعها، وتبرز حالاتها، وتسعى إلى تطوير سبل تفعيلها، واستدراك نقائصها، والمواءمة بدورها تؤثر فيها وتدْعَمُها، ومن مظاهر تأثيرها أنها تعزّز أهداف الدراسات الفقهية والقضائية، كما أنها تُثري التشريعات بالتصورات والاجتهادات الدولية المختلفة، بالإضافة إلى أنها تشكّل دعامة نقدية واستدلالية فعالة في هذه الدراسات. This research studies the influence manifestations of the legislative harmonization in jurisprudence and judicial studies. It aims to define the legislative harmonization and explain its importance. Also to confirmation the need for communication between theoretical studies and legislative activation. It also aims to demonstrate the impact of legislative harmonization in jurisprudence and judicial studies. Noting the reverse effect; through explaining the role of theoretical and critical studies in activating harmonization. Among of the most important results of the research is that legislative harmonization is influenced by jurisprudential and judicial studies, because it defines its elements and motives, highlights its cases, seeks to develop ways to activate it, and rectifies its shortcomings. Harmonization, in turn, affects and supports it, and among the manifestations of its influence is that it enhances the goals of jurisprudential and judicial studies. It also enriches legislation with different international perceptions and jurisprudence. In addition, it constitutes an effective critical and inferential support in these studies
