Description

Refereed International periodical journal concerned with Islamic research and studies in particular and humanity in general. It is published every six months (Hexagonal) by the Department of Islamic Sciences, Faculty of Humanities, Islamic Sciences and Civilization at Ammar Thleiji University - Laghouat - Algeria. She is responsible for publishing research and articles, And Every intellectual production is related to Islamic sciences. And receives research: scientific, national and international, in the three languages: Arabic, English and French. This in order to contribute to the advancement of university studies and the promotion of scientific research, and she is aims to: - Spreading and encouraging the production of researchers and scholars in different categories (professor, researchers, and phd students), especially the researchs that concerned with cultural, social national, Arabic, and international environment. - encouraging Quranic and contemporary studies that has the core of authentic, realistic and modernity. - encouraging jurisprudence studies that tackle issues from the needs of the contemporary humanities. - It deals with appealing, medea and communication studies, particularly those serve the Islamic message. - encouraging the studies that serve spreading the Islamic religions and display it in the correct and simple way, and returning it to its original source. - encouraging immersion in our huge cultural heritage, and present it in different attractive modern way, and to rejuvenate the Muslim' s connection to it, and to display it to all people to absolve them the responsibility before the Lord of the Worlds. - encouraging showing models of translations and the righteous predecessors, and the glories of our Islamic history in general. - It boosts intellectual studies ,also studies in the domains of the history of religions and interfaith comparison, in order to achieve aquaintance and dialogue between members of the human community, and the correct definition of the Islamic message. - the journal Islamic studies is committed to publishing original scientific research that fulfill the required academic conditions refuses to publish anything that violates the ethics of scientific research, repudiates every breach of scientific trust.

مجلة الدراسات الإسلامية تفتح أبوابها لكل عمل جاد وترحب بكافة الباحثين والأساتذة وطلبة الدراسات العليا من داخل الوطن وخارجه الراغبين في نشر أعمالهم و أبحاثهم العلمية

و لأجل تسهيل عملية قبول الأعمال يرجى التقيد بالملاحظات التالية:

1- ضرورة احترام قالب المجلة كليةً (المقالات التي لا يلتزم أصحابها بالقالب ترفض مباشرة).

2- الحرص قبل إرسال المقال التأكد من أن المؤلفين الذين يظهرون في تفاصيل المقالة هم نفس المؤلفين الذين تمّ ذكرهم في ملف المقالة مع ضرورة التأكد من إدخال كافة المساهمين في إعداد المقال سواء كان ذلك في المقال المرسل أو على المنصة.

3- ضرورة إدراج كل من العنوان والملخص والكلمات المفتاحية باللغتين العربية والانجليزية، كما هو مؤكد عليه في دليل المؤلف، وهذا من الشروط الأساسية لمرور المقال للتحكيم.

4-  المؤلفون  مدعوون إلى إدراج المراجع بالكيفية السليمة و هذا بمجرد اشعارهم بقبول المقال للنشر،و في حالة عدم الإلتزام بهذا الإجراء في الآجال المحددة يمكن للهيئة المشرفة على المجلة إلغاء قبول المقال.

5-  لأجل إدارة وعود النشر بشكل الصحيح يجب التقيد بضرورة إدخال المراجع بمجرد استلام الإشعار بالقبول.

6.- بعد نشر المقال من طرف المجلة ليست هناك امكانية إضافة أي مؤلف للمقال.

7- بالنسبة لطلبة الدكتوراه المقبلين على المناقشة ، يجب إدراج  إسم الطالب أولا ثم المشرف ثانيا، مع التأكيد على كتابة البريد الالكتروني ومخبر الانتماء ومؤسسة الانتماء (في المقال المرسل وفي المنصة).

أضواء على الأحكام الفقهية المستنبطة من الهجرة النبوية Spotlight on the jurisprudence rulings deduced from the Prophet's migration

الملخص: لقد تناولت هذه الدراسة موضوعًا من المواضيع المهمة ألا وهو الفقه المستنبط من السيرة النبوية ، ومشكلة البحث تتمثل في أحكام الهجرة ، وأصولها وضوابطها ، واستنباط الأحكام الفقهية من الهجرة النبوية والدروس المستنبطة من الهجرة وأصولها وأحكامها ،ويهدف هذا البحث إلى بيان أثر الهجرة في نشر الإسلام، وبيان الدروس المستفادة من الهجرة، وبيان الأحكام الفقهية المتعلقة بالهجرة ،ودور الشعر العربي في توثيق الهجرة ،حيث تكمن أهمية هذا البحث في إضافة بحث من بحوث اللغة السيرة النبوية للتعرف على المزيد من الدروس المستفادة من السيرة النبوية، والأحكام الفقهية المستنبطة منها ، حتى ينال البحث في السيرة النبوية بذلك مكانة على مكانته ، ومنزلة على منزلته بين بحوث المعرفة والثقافة ، وقد اتبع الباحث في هذه الدراسة المنهج التاريخي الاستقرائي المنهج الوصفي التحليلي، وأظهرت نتائج الدراسة أن انتشار الإسلام وبلوغه مشارق الأرض ومغاربها كان نتيجة للهجرة النبوية المطهرة.The study deals with the importance of migration in the dissemination of Islam and the lessons learned. And the role of Arabic poetry in documenting migration Where the importance of this research is to add research from the language of the Prophet's biography to learn more lessons learned from the biography of the Prophet, and the jurisprudence derived from them, so that the search in the biography of the Prophet that place on the status, and the status of the status between the research of knowledge and culture, In this study the historical method of inductive analytical descriptive method, and the results of the study showed that the spread of Islam and the attainment of the land and most of the land was the result of the Prophet's purified migration.

الملخص: تناقش هذه الورقة إشكالية السيادة الشعبية بوصفها مانعًا من قبول الديمقراطية في المنظور الإسلامي، فمن المشتهر أن السيادة في النظام الديمقراطي تعني أن يكون للشعب السلطة العليا في تحديد التشريع النهائي، وهذا ما يضاد التصور الإسلامي الذي يرى أن السيادة التشريعية يجب أن تكون لله تعالى. وهذا البحث يستشكل هذا الإشكال، ويحاول أن يبحث مدى تحقق المنع الشرعي في فكرة السيادة الديمقراطية، انطلاقًا من إعادة النظر في مفهوم السيادة الديمقراطية ابتداءً من المنشأ ذاته، وهو المرحلة الأثينية. وفي الضفة المقابلة سعى البحث لتحديد تموضع السيادة الإسلامية في التشريع، ومدى تعارضها مع فكرة التشريع الإنساني خارج منطقة النص الشرعي. استند هذا البحث إلى المنهج التحليلي من خلال تحليل عناصر المفاهيم الأساسية، وتحليل محل النزاع والتباين بين الآراء المتعارضة. This paper reviews the problem of popular sovereignty as an obstacle to the acceptance of democracy in the Islamic perspective. It is well-known that sovereignty in a democratic system means that the people have the supreme authority in determining the final legislation. However, this contradicts the Islamic perspective which sees that legislative sovereignty should belong to God Almighty alone. This research refutes this conceptualization and attempts to examine the extent to which the legitimate prohibition is achieved in the idea of democratic sovereignty, based on revisiting the concept of democratic sovereignty starting from its historical source, which is the Athenian stage. The study also seeks to determine the position of sovereignty in Islamic legislation, and the extent to which it may contradict the idea of human legislation outside the area of the legal scriptures. The study follows the analytical approach through analyzing the elements of the basic concepts and analyzing the conflicting and opposing views.

Translating Islamic Religious Expressions: Problems and Strategies

الملخص: Abstract This study is an attempt to investigate the problems that face the translator when translating Islamic religious expressions from Arabic into English. It also explicates the strategies that the translators used in dealing with such problems. The study is descriptive, comparative and evaluative and focuses on how Islamic expressions drawn from the Islamic Arabic book Bidāyat al-Hidāyah are translated by two different translators namely Muhammad Abul Quasem (1979) and Mashhad Al-Allaf (2010). Since the explored religious expressions are deeply rooted in their native culture and constitute a main part of the Arabic-Islamic identity, the findings of the study show that such expressions, in many cases, do not have equivalents in the target language and culture, and translating them into English is very problematic and pose a great challenge to the translator. The findings also reveal that meaning losses and distortions are the result of a host of reasons among which are the sensitivity and peculiarity of the religious expressions and the huge differences between Arabic and English. Exploring the effect of using domesticating and foreignizing translation strategies on the quality of religious translation, its faithfulness and reception, the study shows that the most successful translations are those ones that employ foreignizing strategies. Foreignization that is supplemented with some basic rules of skopos theory helps maintain the identity of the source text and keeps it closer to the original text. It facilitates cultural understanding and communication, familiarizes and educates the TL readers, and enriches the target language and culture. الملخص: تُعدُّ هذه الدراسة محاولة لتحرّي المشكلات التي يواجهها المترجم عند ترجمة التَّعبيرات الدينية الإسلاميّة من العربية إلى الإنجليزية, وكذلك تُعدُّ توضيحًا للاستراتيجيات التي يستخدمها المترجمون عند التعامل مع مثل تلك المشكلات, ونهجت هذه الدراسة منهجًا وصفيًّا مقارنًا نقديًّا, وركّزت على كيفية ترجمة التَّعبيرات الإسلامية المستمدَّة من الكتاب العربي الإسلامي (بداية الهداية) المُترجم من قبل مترجمَين مختلفَين هما: محمد أبو القاسم (1979), ومشهد العلّاف (2010). فأظهرت نتائج هذه الدراسة أنَّ هذه التَّعبيرات غالبًا لا يوجد لها ما يُكافئها في اللغة والثقافة الهدف، وأنَّ نقلها إلى اللغة الإنجليزية يُشكل مُعضلة وتحديًا كبيرًا للمترجم, وذلك نظرًا لأن التَّعبيرات الدينية المُتحراه متجذرة بعمق في ثقافة اللغة المصدر وتُشكل جزءًا رئيسًا من الهويَّة العربية الإسلامية. كما كشفت نتائج هذه الدراسة أن فقدان المعنى وانحرافه عن الأصل هو ناتجٌ عن مجموعة من الأسباب, من بينها حساسية وخصوصيّة التَّعبيرات الدينية والاختلافات الهائلة بين اللغتين العربية والإنجليزية, ومن خلال تحرّي أثر استخدام استراتيجيات التوطين والتغريب على جودة الترجمة الدينية وأمانة نقلها إلى المتلقي أظهرت الدراسة أنّ أنجع التَّرجمات هي تلك التي تستخدم استراتيجيات التغريب. فاستراتيجية التغريب المدعَّمة ببعض القواعد الأساسية لنظرية سكوبوس (نظرية الهدف) تساعد في المحافظة على هويّة النص المصدر وتجعل المعنى أقرب إلى النّص الأصل؛ فهي تساهم في تسهيل الفهم والتواصل الثقافي, كما تعمل على تثقيف المتلقي وتوعيته, وإثراء اللغة والثقافة المستهدفة.
