التعريف بالمجلة:

تعتبر مجلة الدراسات القانونية المقارنة دوريّة دوليّة أكاديميّة محكمة، مجانيّة، نصف سنويّة، مفتوحة الوصول، تصدر عن مخبر القانون الخاص المقارن، وبمساهمة كلية الحقوق والعلوم السياسية، جامعة حسيبة بن بوعلي بالشلف (الجزائر).

تعنى المجلة بالمقالات العلمية القانونيّة المتخصّصة، وذلك في مختلف المجالات ذات الصلة، والتي تتسّم بالأصالة العلميّة والجدّية، وتقبل المجلة بحوث النشر للترقية، كما تقبل بحوث الأساتذة والخبراء الميدانيين باللغة العربية، أو اللغة الفرنسية، والانجليزية، والتي لم يسبق نشرها من قبل، أو تقديمها للنشر في أي مكان آخر، وعلى الباحث أن يتعهد بذلك كتابيا عند تقديم البحث للنشر، ويجب أن يخضع المقال المقدّم للنشر لمعايير وشروط التحكيم المطلوبة في المقال العلمي الأكاديمي حسب الشروط والأصول العلمية المتبّعة (مراجعة الأقران أو النظراء مزدوجة التعمية)، وذلك لضمان الحياد، والنزاهة، والموضوعية من خلال إخفاء هويّة الأطراف.

الدراسات القانونية المقارنة هي مجلة تساهم في نشر ما تجود به قرائح الأساتذة الباحثين المختصين في القانون والشريعة والقانون، من أجل تجليّة النظرة القانونية لعديد الزوايا وإثرائها، وتحليل أرقى التجارب القانونية المقارنة -العربية منها والغربية- ومناقشتها وتثمينها والإفادة منها.

وفي الوقت الذي نصدر فيه مجلة الدراسات القانونية المقارنة، نتطلّع إلى أن يتعزّز البحث العلمي الجامعي، بما يقدّمه الأساتذة الباحثون من أعمال علمية ودراسات قانونية، تجعل من المجلة ثابتة على خطى الإبداع والتجديد، وفاعلة في التواصل بين كافة المنتمين إلى الحقل القانونيّ، ومساهمة في إنشاء منظومة قانونيّة، تتوافق وتطلعات المجتمع المستقبليّة، وتنهض به لمواجهة ما قد يعترض طريق رقيّه وتطوّره. وفي الأخير تأمل هيئة التحرير أن تترجم حرصها الدائم على رصانة هذا المنبر العلمي، بإتباع التقاليد المحكمة في تقويم البحوث علميا من قبل الخبراء في الاختصاصات الدقيقة ملتزمة طريق المجلات العلمية العريقة دون التّخلي عن لمسات الإبداع والتطوير.كما تود هيئة تحرير المجلة من قرائها أن يتفاعلوا معها، من خلال موقعها على شبكة الإنترنت، وبريدها الإلكتروني بإبداء ملاحظاتهم، وتقديم مقترحاتهم، التي يرون أنّها يمكن أن يكون لها مردود جيد على تطوير المجلة والارتقاء بها.

Journal Presentation:

The Comparative Legal Studies Journal is an international, free, academic, peer-reviewed, biannual journal, open access (CC BY-NC) issued by the Laboratory of Comparative Private Law in collaboration with the Faculty of Law and Political Sciences of Hassiba Ben Bouali University, Chlef (Algeria).

The journal publishes scholarly articles specialized in various legal fields and respecting the conditions of authenticity and seriousness. Our journal accepts research for promotion. It also welcomes professors' and field experts' research in Arabic, French or English providing that it has not been previously published or submitted for publication elsewhere. The researcher submitting a paper for publication commits to this in a written form. The submitted article must obey the scientific terms and principles, the criteria and conditions required, and applied in the academic articles(double-blind peer review), in order to ensure neutrality, integrity, and objectivity by concealing the identity of the parties.

Comparative legal studies is a journal that aims at revealing the unique contributions of researchers specializing in law, or in Sharia law, or Sharia law to clarify and enrich the legal view from many angles. It also aims to analyse the finest comparative legal experiences (both Arab and Western), discuss them, evaluate them and benefit from them. With the scientific works and legal studies provided by our researchers and professors, we look forward to strengthening scientific research and contribute to it.

We aspire for creativity and innovation and cater for effective communication between all members of the legal field. We also aspire to contribute to establish a legal system that is compatible with the future of our society and help it confront what might hinder its development and prosperity.

The editorial board hopes to convey its eagerness for promoting this scientific platform, by following the established traditions of scientific evaluation by experts in subspecialties who are committed to the path of long-standing scientific journals without neglecting our touches of creativity for development. The editorial board of the journal would like its readers to interact with it through its website and e-mail, express their opinions and submit suggestions that can have a good impact on the development and advancement of the journal.

Présentation de la revue:

Le «Journal des Etudes Juridiques Comparées» est une revue internationale académique, gratuite, semestrielle,à accès libre, publiée par le Laboratoire de Droit Privé Comparé en collaboration avec la Faculté de Droit et de Sciences Politiques de l'Université Hassiba Ben Bouali, Chlef (Algerie).

La revue publie des articles scientifiques juridiques spécialisés dans divers domaines y afférents, respectant les conditions d'authenticité scientifique et de sérieux. La revue accepte les recherches dédiées à la promotion, et accueille également les recherches des professeurs et des experts de terrain en arabe, en français et en anglais, à condition qu'elles n'aient pas été préalablement publiées ou soumises pour publication ailleurs. Le chercheur qui soumet un article pour publication s'y engage sous forme écrite. L'article soumis doit répondre aux critères et conditions d’arbitrage requis et appliqués sur les articles scientifiques, selon les termes et principes reconnus (Évaluation par les pairs en double aveugle) pour garantir la neutralité, l'intégrité et l'objectivité en dissimulant l'identité des parties.

Le «Journal des Etudes Juridiques Comparées» est une revue qui vise à révéler les contributions uniques des chercheurs Des chercheurs spécialisés en droit, ou en charia et droit pour clarifier et enrichir la vision juridique sous différents angles. Elle vise également à analyser les meilleures expériences juridiques comparatives -arabes et occidentales- à en discuter, à les évaluer et à en tirer profit. Avec les recherches scientifiques et les études juridiques fournies par nos professeurs chercheurs et publiées par notre revue, nous souhaitons renforcer la recherche scientifique et d'y contribuer. Nous aspirons à la créativité et à l'innovation et assurons une communication efficace entre tous les membres du domaine juridique. Nous aspirons également à contribuer à la mise en place d'un système juridique compatible avec les attentes de notre société et à l'aider à faire face à ce qui pourrait entraver son développement et sa prospérité. En définitive, le comité de rédaction espère transmettre son empressement à promouvoir cette plateforme scientifique, en suivant les traditions d'évaluation scientifique par des experts en surspécialités et adhérant à la voie des revues scientifiques bien établies, sans oublier les retouches de créativité et de développement. Le comité de rédaction de la revue invite ses lecteurs à interagir via son site Web et son courrier électronique, en expriment leurs opinions et suggestions qui jugent avoir un bon impact sur le développement et l'avancement de la revue.

فتح أجل استقبال المقالات

السلام عليكم،

تحية طيّبة وبعد،

تعلن هيئة تحرير مجلة الدراسات القانونية المقارنة عن فتح آجال استقبال المقالات العلمية حاليا، تحضيرا لعدد جوان 2026 -إن شاء الله تعالى-، وذلك خلال الفترة الممتدة من 09 مارس إلى 16 مارس 2026

ونذّكر السادة المؤلفين المهتمين بالنشر في مجلتنا، بضرورة الأخذ بعين الاعتبار ما يلي:

ضرورة احترام تخصص المجلة؛ وذكره ضمن بيانات الباحث، فالمجلة متاحة فقط للمتخصصين في القانون، أو الشريعة والقانون، والذي ينبغي ذكره في بيانات الباحث، تجنبا لرفض المقال شكلا.
ضرورة الالتزام بقالب المجلة بحذافيره تجنبا لرفض المقال شكلا.
الالتزام بعدم سبق إرسال المقال إلى مجلة أخرى تجنبا للرفض.
ضرورة ذكر كل أسماء المؤلفين عند تسجيل المقال في المنصة، لأنّه لا يمكن بأي شكل إضافة أي مؤلف في حال عدم ذكره.
ضرورة ذكر المشرف بالنسبة للمقال المرسل من طرف طالب الدكتوراه، إلاّ في حال تنازله،
ضرورة ذكر مخبر الانتماء لاسيّما بالنسبة لطلبة الدكتوراه.
القرار المبدئي لقبول المقال يكون تلقائيا تبعا لنتيجة فحص التشابه بواسطة البرنامج المتاح عبر المنصة، والذي تخضع له كلّ المقالات دون استثناء.
الالتزام بمواعيد الرد، والتعديل وإعادة الإرسال بالنسبة للمقالات المقبولة بتحفظ، والإدخال الفوري للمراجع بمجرد القبول النهائي للمقال.

نولي أهميّة كبرى للملاحظات المذكورة أعلاه.

إرجاع المقال لصاحبه مع تبيان سبب الرفض، من أجل تعديله

مقال مطابق لشروط وقواعد النشر

قبول المقال:
حذف جميع المعلومات الخاصّة بصاحب المقال، مع إعطائه رقم سريّ، وإسناده لمحرّر مساعد، أو للتحكيم مباشرة.
يتمّ إسناد المقال لمراجعين اثنين على الأقل، وإلى المحكم الثالث في حالة اختلاف رأيهما بين القبول والرفض

القرار النهائي: مقال مقبول

إذا كان قرار المراجعين الاثنين قبول المقال

القرار النهائي: مقال مرفوض

إذا كان قرار المراجعين الاثنين رفض المقال

القرار النهائي: مقال مقبول بتحفظ

قرار المراجع الأوّل والثاني: مقال مقبول مع تعديلات صغيرة أو كبيرة، منح مؤلف المقال مهلة 15يوما من أجل إرسال التعديلات، وإعادة إرساله للمراجعين، إذا كان قرار المراجعين رفض المقال بعد التعديل يرفض المقال.

إذا كان المقال مقبول من قبل من طرف المراجع الأول، ومرفوض من قبل المراجع الثاني:

يسند المقال لمراجع ثالث، وقراره هو الفاصل، إذا قبل المقال فهو مقبول، وإذا رفض المقال فهو مرفوض، وإذا قبله بتحفظ، يرسل لإعادة التعديل، فإذا قبل التعديل فهو مقبول، وإذا رفض المقال فهو مرفوض
