الملخص
يهدف هذا البحث إلى قياس مدى مواءمة التشريعات والسياسات العراقية مع المعايير الدولية والإسلامية في حماية حرية الفكر والوجدان والدين للأطفال، بوصفها حقًا أساسيًا تتقاطع فيه المرجعيات الدستورية والشرعية والاتفاقيات الدولية. وقد اعتمدت الدراسة منهجًا تحليليًا مقارنًا تناول النصوص القانونية والتفسير الفقهي والممارسات المؤسسية، مع التركيز على التبعية الدينية، وحرية الإظهار، ودور الأسرة، وأظهرت النتائج توافقًا شبه كامل في حرية الفكر والوجدان، وتوافقًا متوسطًا في الإظهار، وتعارضًا في حرية الدين من حيث الاختيار والتغيير. وانتهى البحث إلى توصيات تشريعية وسياساتية وخارطة تنفيذ زمنية، تهدف إلى تعزيز الضمانات القانونية وضبط القيود، بما يحقق التوازن بين الثوابت الوطنية والالتزامات الدولية. Abstract: This study aims to assess the extent to which Iraqi legislation and policies align with international and Islamic standards in safeguarding children’s right to freedom of thought, conscience, and religion—a fundamental right situated at the intersection of constitutional, religious, and international legal frameworks. Adopting a comparative analytical methodology, the research examines legal texts, jurisprudential interpretations, and institutional practices, with particular focus on religious affiliation, freedom of manifestation, and the role of the family. Findings reveal near-complete alignment in protecting children’s freedom of thought and conscience, moderate alignment in the freedom to manifest belief, and significant divergence in the freedom of religion, particularly regarding choice and conversion. The study concludes with legislative, policy, and implementation-oriented recommendations, including a time-bound action framework aimed at strengthening legal safeguards and regulating restrictions in a manner that balances national foundations with Iraq’s international obligations.
