الحماية الجنائية للحدث من تعاطي المسكرات (الكحول) دراسة مقارنة بين قانون العقوبات العراقي والتشريعات العربية The Criminal Protection For Juvenile From Abusing Of Intoxicants (alcohol): A Comparative Study Between The Iraqi Penal Code And Arab Legislation

الملخص
يتناول هذا البحث الحماية الجنائية للحدث من تعاطي المسكرات في قانون العقوبات العراقي مقارنة بالتشريعات العربية. الغرض منه هو بيان الجرائم التي نصّت عليهما المادتين (387)، و(388) من القانون العراقي، التي من خلالها تم حماية الحدث من تعاطي المسكرات، وبيان فيما إذا كانت المواد المذكورة تعاني ثغرات تشريعية من عدمها. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي، المقارن، والنقدي. وأهم النتائج التي توصلت إليها البحث، هي: إن المادتين (387) و(388) نصّتا على ثلاث جرائم لغرض حماية الحدث من تعاطي المسكرات، وأن المواد المذكورة تعاني عدداً من الفجوات التشريعية، منها: عدم شمول الصغير بالحماية، وعدم مسؤولية الجاني إن قدّم المسكر للحدث لغرض المداواة. واختتم البحث بتوصية المشرع بتعديل المواد المذكورة أعلاه لسد الفراغ التشريعي فيها، واقترحنا عليه نصوصاً بديلة لتجنب المآخذ الموجهة إليها قدر الإمكان. This research deals with the criminal protection for juvenile from abusing of intoxicants in the Iraqi Penal Code comparing to the Arab legislation. Its purpose is to show the crimes stipulated in articles (387) and (388) of Iraqi law, through which the juvenile was protected from abusing of intoxicants and showing whether the aforementioned articles suffer from legislative loopholes or not. In order to achieve this, the researcher used the analytical inductive, comparative, and critical method. The most important findings of the research are: articles (387) and (388) stated three crimes for protecting juveniles from abusing intoxicants, and the aforementioned articles suffer from a number of legislative loopholes, including: The minor is not covered by protection, the non-responsibly of the perpetrator if he gives intoxicants to the juvenile for treatment. The research concluded with recommending the legislator to amend the above-mentioned articles to fill the legislative gap in them, and we suggested alternative texts to avoid the criticisms directed to them as much as possible.
