جريمة تحريض الحدث على السرقة في قانون العقوبات العراقي: دراسة مقارنة The Crime Of Inciting A Juvenile To Stealing In The Iraqi Penal Code: A Comparative Study

الملخص

يتناول هذا البحث أحكام جريمة تحريض الحدث على السرقة في قانون العقوبات العراقي التي وردت في المادة (448) مقارنة بالتشريعات العربية. الغرض منه هو بيان أحكام الجريمة المذكورة في القانون العراقي، وفيما إذا كانت المادة المذكورة تعاني ثغرات تشريعية من عدمها. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي، المقارن، والنقدي. وأهم النتائج التي توصل إليها البحث، هي: إن المشرع العراقي حاول تناول جميع أحكام جريمة تحريض الحدث على السرقة من خلال المادة (448) ولقد كان موفقاً إلى حد بعيد، ورغم ذلك فإن المادة المذكورة تعاني عدداً من الفجوات التشريعية، منها: عدم شمول الصغير الذي لم يتم التاسعة من عمره بالحماية الجنائية، عدم تخصيص فقرة لحالة اجتماع أكثر من ظرف مشدّد في الجريمة وعقوبة الجاني فيها. واقترحنا نصوصاً بديلة لتجنب المآخذ الموجهة إليها قدر الإمكان. This research deals with the provisions of the crime of inciting juvenile to stealing in the Iraqi Penal Code, which is mentioned in article (448), comparing to Arab legislations. Its purpose is to clarify the provisions of the aforementioned crime in Iraqi law, and whether the aforementioned article suffers from legislative loopholes or not. In order to achieve this, the researcher used the analytical inductive, comparative, and critical method. The most important findings of the research are: The Iraqi legislator attempted to address all the provisions of the crime of inciting juvenile to steal through article (448), and he was largely successful. Despite this, the aforementioned article suffers from a number of legislative gaps, including: the minor under the age of nine is not covered by criminal protection, not allocating a legal text to a situation of existence more than one aggravating circumstance in the crime and the punishment of the perpetrator. We suggested alternative texts to avoid the criticisms directed to them as much as possible.
