الملخص

يهدف هذا البحث إلى تقييم حقوق الأطفال ذوي الإعاقة في العراق وإقليم كوردستان من خلال تحليل القانون الاتحادي رقم (38) لسنة 2013 وقانون الإقليم رقم (22) لسنة 2011، ومقارنتها باتفاقية حقوق الأشخاص ذوي الإعاقة واتفاقية حقوق الطفل، بغرض بيان مدى انسجام التشريعات الوطنية مع الالتزامات الدولية. اعتمد البحث على المنهج التحليلي المقارن للنصوص القانونية والمصادر الدولية. وتوصل إلى أن التشريعات تضمنت نصوصًا متقدمة في مجالات الصحة والتعليم والإعانات الاجتماعية، لكنها تعاني من قصور في التطبيق وضعف في آليات التنفيذ، إضافة إلى غياب التوحيد الاصطلاحي بين المفاهيم. ويوصي البحث بتطوير السياسات التنفيذية، وتعزيز التمويل، وتوحيد المفاهيم، وتفعيل آليات المتابعة لضمان حماية أكثر فعالية لهذه الفئة This study aims to evaluate the rights of children with disabilities in Iraq and the Kurdistan Region through an analysis of Federal Law No. 38 of 2013 and Kurdistan Regional Law No. 22 of 2011, in comparison with the Convention on the Rights of Persons with Disabilities (CRPD) and the Convention on the Rights of the Child (CRC), with the purpose of assessing the extent to which national legislation aligns with international obligations. The research adopts a comparative analytical methodology, examining legal texts alongside international sources. The findings reveal that while the legislation contains advanced provisions in the fields of health, education, and social allowances, it suffers from shortcomings in implementation and weak enforcement mechanisms, in addition to the absence of unified terminology between key concepts. The study recommends developing executive policies, increasing financial support, unifying legal terminology, and activating monitoring mechanisms to ensure more effective protection for this group.
