الملخص
يتناول هذا البحث موضوع عمالة الأطفال في العراق من زاوية التوافق بين التشريعات الوطنية والمعايير الدولية ذات الصلة، خصوصًا اتفاقية حقوق الطفل واتفاقيات منظمة العمل الدولية رقم (138) و(182). يهدف البحث إلى تحليل مدى انسجام القوانين العراقية، لاسيما قانون العمل، وقانون رعاية الأحداث، وقانون التعليم الإلزامي، مع تلك الاتفاقيات، من خلال منهج تحليلي مقارن يجمع بين دراسة النصوص القانونية وتقييم التطبيق العملي لها. وقد أظهر البحث وجود تطورات تشريعية ملحوظة، إلا أنها لا ترقى إلى مستوى المعايير الدولية، لا سيما في ما يتعلق بضعف آليات الرقابة، وغياب السياسات الوقائية الفعالة، وتفشي ظاهرة عمل الأطفال في قطاعات غير منظمة. كما بيّنت الدراسة أن الجهود الحكومية لا تزال مشتتة وتعاني من غياب استراتيجية وطنية شاملة لمعالجة جذور الظاهرة. واختتم البحث بجملة من التوصيات الهادفة إلى مواءمة التشريعات وتعزيز تنفيذها، تأكيدًا على أن حماية الأطفال من الاستغلال الاقتصادي مسؤولية جماعية تشريعية وتنفيذية This research examines the issue of child labor in Iraq through the lens of the alignment between national legislation and relevant international standards, particularly the Convention on the Rights of the Child and the International Labour Organization Conventions No. 138 and No. 182. The study aims to analyze the extent to which Iraqi laws—especially the Labor Law, the Juvenile Welfare Law, and the Compulsory Education Law—are consistent with these conventions, using a comparative analytical approach that combines the study of legal texts with an evaluation of their practical application. The research highlights that, although there have been significant legislative developments, they remain insufficient to meet international standards—particularly in relation to weak oversight mechanisms, the absence of effective preventive policies, and the widespread occurrence of child labor in informal sectors. The study further demonstrates that governmental efforts are still fragmented and suffer from the lack of a comprehensive national strategy to address the root causes of the phenomenon. The research concludes with a set of recommendations aimed at harmonizing legislation and enhancing its enforcement, reaffirming that protecting children from economic exploitation is a shared legislative and executive responsibility
