الاتجار بالطفل من منظور القانون الدولي لحقوق الإنسان والقانون العراقي: دراسة تحليلية مقارنة Child Trafficking From The Perspective Of International Human Rights Law And Iraqi Law: A Comparative Analytical Study

الملخص
يتناول هذا البحث جريمة الاتجار بالطفل من منظور المعايير الدولية والتشريع العراقي، مع تركيز خاص على مدى توافق القانون العراقي مع الصكوك الدولية مثل اتفاقية حقوق الطفل وبروتوكول باليرمو. اعتمد الباحث المنهج التحليلي والنقدي والمقارن لاستكشاف الأطر القانونية الوطنية والدولية، بالإضافة إلى واقع التطبيق العملي في العراق. وقد خلص البحث إلى أن الصكوك القانونية الدولية توفر حماية شاملة للأطفال دون اشتراط وجود وسائل قسرية، في حين لا يزال القانون العراقي، رغم ما أحرزه من تطور تشريعي، يعاني من إشكاليات على مستوى التنفيذ، ولا سيما فيما يتعلق بشرط الوسائل القسرية، وضعف التنسيق، ونقص التمويل والتخصص. كما تؤكد الإحصاءات استمرار تفاقم ظاهرة الاتجار بالأطفال في العراق، مما يستدعي تعزيز التشريعات وتفعيل آليات التنفيذ لضمان حماية فعّالة. ختامًا، فإن حماية الأطفال من الاتجار تُعدّ مسؤولية قانونية وأخلاقية تتطلب تعاونًا وطنيًا ودوليًا مشتركًا. Abstract: This study examines the crime of child trafficking from the perspective of international standards and Iraqi legislation, with a particular focus on the extent to which Iraqi law aligns with international instruments such as the Convention on the Rights of the Child and the Palermo Protocol. The researcher adopts an analytical, critical, and comparative approach to explore both the national and international legal frameworks, as well as the practical implementation in Iraq. The study concludes that international legal instruments provide comprehensive protection for children without requiring the presence of coercive means. In contrast, despite notable legislative developments, Iraqi law still faces challenges in implementation—particularly with regard to the coercive means requirement, lack of coordination, insufficient funding, and limited specialization. Statistical data also confirms the continued escalation of child trafficking in Iraq, highlighting the need to strengthen legislation and activate enforcement mechanisms to ensure effective protection. In conclusion, protecting children from trafficking is both a legal and moral obligation that requires joint national and international cooperation.
