الملخص
يتناول هذا البحث حق الطفل في الراحة وأوقات الفراغ ومزاولة الأنشطة الثقافية والفنية، بوصفه حقًا أصيلًا في القانون الدولي لحقوق الإنسان، مع تحليل مدى توافق التشريع العراقي مع الالتزامات الدولية، ولا سيما اتفاقية حقوق الطفل وتعليقها العام رقم (17)، والمواثيق العربية والإسلامية ذات الصلة. اعتمدت الدراسة منهجًا تحليليًا مقارنًا بين المستويات الأربعة (الدولي، الإقليمي، العربي، الإسلامي) والإطار الوطني، للكشف عن أوجه الاتفاق والاختلاف وتحديد الفجوات التشريعية والتطبيقية. أظهرت النتائج وجود اعتراف ومواءمة عامة، لكن مع قصور في التفصيل وضعف في آليات التنفيذ والرقابة، مما يستدعي استكمال البناء التشريعي وتعزيز التنسيق المؤسسي وتخصيص الموارد. ويختتم البحث بتوصيات عملية لضمان حماية هذا الحق وتفعيل تطبيقه. This study examines the child’s right to rest, leisure, and to participate in cultural and artistic activities as a fundamental entitlement under international human rights law, with a focus on assessing the degree of alignment between the international framework and the national legal system in Iraq. It analyzes the extent to which Iraqi legislation complies with relevant international obligations, particularly the Convention on the Rights of the Child and its General Comment No. 17, as well as pertinent Arab and Islamic instruments. The research adopts a comparative analytical methodology, juxtaposing the four normative levels (international, regional, Arab, and Islamic) with the Iraqi legal framework to identify areas of convergence and divergence, and to pinpoint legislative and practical gaps. The findings reveal a general recognition and partial harmonization of this right within Iraqi law, yet highlight deficiencies in the level of detail, as well as weaknesses in implementation and oversight mechanisms. The study concludes with legislative, policy, and institutional recommendations aimed at completing the national legal framework, strengthening inter institutional coordination, and ensuring adequate resource allocation to guarantee the effective protection and realization of this right.
