الملخص
يتناول هذا البحث حق الطفل في الهوية على ضوء الصكوك الدولية والقانون العراقي. الغرض منه هو بيان الصكوك الدولية التي تناولت حق الطفل في الهوية وموقفها من هذا الحق، وفيما إذا كان القانون العراقي قد أضفى حماية جنائية رادعة ضد الجناة معرضي حق الطفل في الهوية للخطر، ومعرفة فيما إذا كان هناك توافق أو تصادم بين الصكوك الدولية والقانون العراقي. وفي سبيل تحقيق ذلك، استخدم الباحث المنهج الاستقرائي التحليلي، المقارن، والنقدي. وأهم النتائج التي توصلت إليها البحث، هي: وجود عدّة صكوك دولية تناولت حق الطفل في الهوية، بعضها خاصة بحقوق الطفل وأخرى عامة متعلقة بحقوق الإنسان، وقد أضفى القانون العراقي حماية جزائية غير صارمة لحق الطفل في الهوية سواء من ناحية العقوبات أو نطاق الأطفال المشمولين بهذا الحق، كما إن القانون العراقي كان على انسجام وتوافق كبير مع الصكوك الدولية، سوى في جوانب معيّنة. واختتم البحث بعدد من التوصيات موجهة للمجتمع الدولي والمشرع العراقي. Abstract: This research deals with the child's right to identity in the light of international instruments and Iraqi law. Its purpose is to show the international instruments that deal with the child's right to identity and their stand on this right, and whether the Iraqi law has added criminal protection against perpetrators who endanger child's right to identity, and to find out if there is an agreement or conflict between the international instruments and the Iraqi law. In order to achieve this, the researcher used the analytical inductive, comparative, and critical method. The most important results of the research are: There are several international instruments that address the child’s right to identity, some of which are specific to children’s rights and others are general related to human rights. Iraqi law has provided non-strict criminal protection for the child’s right to identity, whether in terms of penalties or the scope of children covered by this right. The Iraqi law was also in harmony and great agreement with international instruments, except in certain aspects. The research concluded with a number of recommendations directed to the international community and the Iraqi legislator.
