الملخص
يهدف هذا البحث إلى دراسة حق الطفل في التمتع بأعلى مستوى صحي يمكن بلوغه، وتحليل مدى انسجام التشريعات العراقية مع الالتزامات الدولية، ولا سيما اتفاقية حقوق الطفل وتعليقها العام رقم (15)، والعهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية، إضافة إلى المواثيق العربية والإسلامية ذات الصلة. اعتمدت الدراسة منهجاً تحليلياً مقارناً بين المستويات الدولية والإقليمية والعربية والإسلامية والإطار الوطني، للكشف عن أوجه الاتفاق والاختلاف ورصد الفجوات التشريعية والتطبيقية. أظهرت النتائج وجود توافق عام في المبادئ بين الصكوك الدولية والتشريعات الوطنية، إلا أن هذا التوافق يظل جزئياً على مستوى التطبيق، بسبب ضعف الدمج التشريعي الكامل لأحكام الاتفاقيات الدولية، وغياب تعريفات دقيقة للمفاهيم، وضعف آليات الإنفاذ والرقابة، وغياب نصوص ملزمة للتمويل المستدام، خاصة فيما يتعلق بالفئات الهشة. وأكدت النتائج الحاجة إلى إصلاحات تشريعية ومؤسسية لضمان الانسجام بين الإطارين الدولي والوطني، وتحويل الالتزامات إلى سياسات قابلة للتنفيذ. Abstract: This study explores the child’s right to the highest attainable standard of health as a core entitlement under international human rights law, assessing the extent to which Iraqi federal legislation and that of the Kurdistan Region comply with relevant international obligations, particularly the Convention on the Rights of the Child and its General Comment No. 15, the International Covenant on Economic, Social and Cultural Rights, and pertinent Arab and Islamic instruments. Using a comparative analytical approach, the research examines international, regional, Arab, and Islamic frameworks alongside the national legal system to identify convergence, divergence, and key legislative and practical gaps. The findings reveal general alignment in principles but highlight incomplete incorporation of treaty provisions, lack of precise legal definitions, weak enforcement and oversight, and absence of binding provisions for sustainable funding—especially for vulnerable groups. The study calls for targeted legislative and institutional reforms to ensure harmonization between international commitments and national implementation.
