Abstract: This study examines the transformative role of nanotechnology within the criminal justice system by analyzing its superior ability to interrogate minute and complex physical evidence that traditional forensics fails to detect or process. The effectiveness of this technology is demonstrated through advanced analytical capabilities that contribute to revealing latent fingerprints, analyzing DNA at trace concentrations, and recovering digital data from damaged media, thereby ensuring judicial certainty that transcends mere speculative probabilities. Within the framework of the Algerian legislative reality, the study highlights the emerging procedural and judicial challenges, particularly under Law 25-14, while emphasizing the strategic role of the Center for the Development of Advanced Technologies (CDTA) in localizing these technologies and providing the necessary legal calibration to ensure the credibility of laboratory results. The study concludes with the imperative of aligning national procedural rules with the specificity of "atomic evidence" and envisioning the model of the "Technical Judge" qualified to deliberate complex scientific expertise. This is essential to guarantee the independence of judicial decisions and achieve technical sovereignty in combating contemporary crimes. Furthermore, the study stresses the necessity of establishing strict legal and ethical constraints that safeguard bodily integrity and genetic privacy as mandatory boundaries that must not be bypassed in the context of modern nano-evidence practices.
