Abstract: This comparative study aims to analyze custody provisions in the Algerian Family Law and the Tunisian Personal Status Code, focusing on the principle of the best interests of the child. The analysis reveals a fundamental divergence: Algerian law relies on a hierarchical arrangement for custody beneficiaries, derived from Fiqh (Islamic jurisprudence), while granting the judge limited discretionary power. In contrast, the Tunisian legislation adopts a modern approach, abolishing the mandatory hierarchy and making the child's interest the sole criterion, granting the custodial mother guardianship (Wilaya) powers related to education and travel. The research concludes that the Algerian law needs updating to enhance judicial flexibility and support the independence of the custodial mother.
