الملخص
يهدف البحث إلى دراسة مكتب دراسة الشخصية في محاكم الأحداث العراقية من حيث التشكيل القانوني وآليات العمل ومقارنته بالصكوك الدولية والعربية والإسلامية والإقليمية، حيث تكمن الإشكالية في وجود فجوة بين الانسجام التشريعي والتطبيق العملي نتيجة ضعف الموارد البشرية وقصور التدريب والتنسيق المؤسسي، وقد اعتمد البحث منهجية تحليلية–مقارنة للنصوص الوطنية والمرجعيات الدولية، وأظهرت النتائج أن المكتب يمثل مؤسسة بحثية–قضائية متخصصة منسجمة مع المبادئ الدولية لكنه يواجه تحديات في التفرغ والاحترافية، فيما خلصت التوصيات إلى ضرورة تعزيز البنية المؤسسية وتوفير التدريب المستمر وتطوير أدوات جمع المعلومات وتفعيل آليات متابعة لاحقة للتقارير، بما يحقق العدالة الإصلاحية والمصلحة الفضلى للطفل الحدث. Abstract: The research aims to examine the Personality Study Office in Iraqi Juvenile Courts in terms of its legal formation and working mechanisms, and to compare it with international, Arab, Islamic, and regional instruments to ensure child protection. The problem lies in the gap between legislative harmony and practical application, due to weak human resources, insufficient training, and limited institutional coordination. The study adopted an analytical–comparative methodology of national legal texts and international and regional references. The findings revealed that the office constitutes a specialized research–judicial institution consistent with international principles, yet it faces challenges in terms of dedication and professionalism. The recommendations emphasized the need to strengthen the institutional structure, provide continuous training, develop information–gathering tools, and activate follow–up mechanisms for reports, thereby ensuring rehabilitative justice and the best interests of the child.
