الملخص
يحلل البحث مفهوم التشرد وانحراف السلوك في قانون رعاية الأحداث العراقي ومدى انسجامه مع المعايير الدولية، مبرزًا غياب التعريفات الدقيقة وضعف البنية المؤسسية، ويوصي بإعادة صياغة المفاهيم وتبني سياسات وطنية شاملة ترتكز على التعليم ودعم الأسرة ومكافحة الفقر مع تقليص العقوبات السالبة للحرية. كما يؤكد على ضرورة إدماج الطفل في الإجراءات القضائية وتعزيز الدور الوقائي والإصلاحي لضمان حماية أكثر فاعلية لحقوقه. The study analyzes the concept of vagrancy and behavioral deviation in the Iraqi Juvenile Welfare Law and its alignment with international standards, highlighting the absence of precise definitions and institutional weaknesses. It recommends revising legal concepts and adopting comprehensive national policies centered on education, family support, and poverty reduction, while limiting custodial penalties to a last resort. The research further emphasizes the necessity of integrating the child into judicial procedures and strengthening preventive and reformative measures to ensure more effective protection of children’s rights.
