خصوصية سلطتي ضبط مجال الاعلام بين الاستقلالية والتقييد

الملخص
الملخص: بعد تقييم تجربة الجزائر بغير الناجحة في مجال اقرار فكرة الضبط في مجال الاعلام من خلال المجلس الأعلى للإعلام الذي أقرته المادة 59 من القانون 90-07 والذي تم حله، أحدث المشرع الجزائري بموجب القانون العضوي 12-05 المتعلق بالإعلام سلطتين ضابطتين للممارسة الاعلامية في الجزائر وهما سلطة ضبط الصحافة المكتوبة و سلطة ضبط السمعي البصري و اوكل لهما صلاحيات اساسية في مجال حرية الصحافة والعمل الاعلامي لذلك كان لابد من أن تتمتعا بالاستقلالية الادارية والمالية، هذا مادفع بالمشرع الى التنصيص على تلك الاستقلالية في قانون الاعلام وقانون النشاط السمعي البصري بموجب القانون 14-04 من خلال تقدير الاستقلالية لاسيما من الناحية العضوية و الوظيفية . هذا كله ناهيك عن تبعيتهما للسلطة التنفيذية كالتزام هاتين السلطتين قانونا بإرسال تقريرا سنويا عن مجال نشاطاتهما الى رئيس الجمهورية و احتكاره سلطة تعيين الاعضاء، بالإضافة الى انعدام الاستقلالية المالية. Abstract: After assessing Algeria’s unsuccessful attempt to establish media oversight through the Supreme Media Council—created under Article 59 of Law 90-07 and later dissolved—the Algerian legislator introduced two regulatory bodies under Organic Law 12-05 on media. These are: the authority responsible for overseeing the written press and the authority for regulating audiovisual media. Both were granted essential powers related to press freedom and media operations, which necessitated that they enjoy administrative and financial independence. As a result, the legislator emphasized this independence in both the Media Law and the Audiovisual Activity Law(Law 14-04), particularly with regard to membership and operational functions. Nevertheless, this independence remains questionable due to the subordination of these bodies to the executive branch. For example, both authorities are legally required to submit an annual report on their activities to the President of the Republic, who also holds the exclusive power to appoint their members. Moreover, they lack genuine financial autonomy
