الملخص

ملخص: تهدف هذه الدراسة؛ لتسليط الضوء على المسؤولية الجزائية للأشخاص الاعتبارية على الجرائم الاقتصادية؛ التي أصبحت جرائمها أخطر بكثير من الجرائم المرتكبة من الشخص الطبيعي؛ حيث عالجت الدراسة؛ التعريف بالشخصية الإعتبارية، والمسؤولية الجزائية، وكذا الجرائم الإستثمارية في محورها الأول، كما تطرقت الدراسة في محورها الثاني؛ إلى أهم وأبرز القوانين التي أدانت الأشخاص الاعتبارية؛ لتخلص الدراسة؛ إلى أهم النتائج والمقترحات التي تم التوصل إليها، ومن بين هذه النتائج: أن قیام المسؤولیة الجزائية للشخص المعنوي؛ سُبِقَ باقرار فقهي وقضائي، بتحمیله للمسؤولیة المدنیة، وكان نتیجة حتمیة أملتها اعتبارات عملیة وواقعیة. Abstract : This study aims to shed light on the criminal liability of legal entities for economic crimes, which have become significantly more serious than those committed by natural persons. The first section of the study examines the definition of legal personality, criminal liability, and investment-related crimes. The second section focuses on the most significant laws that have established the criminal liability of legal entities.The study concludes with key findings and recommendations, one of which is that the establishment of criminal liability for legal entities was not arbitrary. It was preceded by both doctrinal and judicial recognition of the existence of legal persons and their potential civil liability, making the imposition of criminal responsibility an inevitable consequence dictated by practical and legal considerations
