An international, bi-annual, free and peer-reviewed journal published by the Research Center of the Islamic Sciences and Civilization Laghouat – Algeria. The journal focuses on publishing research and articles in the fields of Islamic, human and social sciences, it receives scientific research in the three languages: Arabic, English and French. It aims to: - Publish and encourage the production of researchers and scholars, including professors, researchers and doctoral students, especially research related to the cultural and social environment, regarding to Islamic sciences. – Promote scientific research in Islamic studies and Islamic heritage in general – Encourage intellectual studies, as well as studies in the field of comparative religion to achieve human dialogue and introduce Islam – Encourage jurisprudence, Quranic and hadith studies to serve intellectual issues, especially emerging ones – Encourage research in the fields of social and human sciences. The journal is committed to publish original research that fulfills the required academic conditions, and rejects what violates the ethics of scientific research and scientific integrity.

الملخص: تتلخص هذه الدراسة في أنها تسعى إلى تسليط الضوء على مسألة التعويض عن الضرر من منظور مقصدي حفظ المال واعتبار المآل. وتتبع هذه الدراسة المنهج الوصفي التحليلي في عرض الآراء والأدلة ومناقشتها مناقشة موضوعية بعيدة عن الخلفيات والتوجهات. وتكمن هذه الأهمية في أنها تعالج هذه المسألة من جانبين: من جانب البعد المقاصدي، ومن جانب الواقع العملي، حيث وازنت الدراسة بين الجانبين، فكانت البنوك الإسلامية الجزائرية موضوع التطبيق والدارسة، وقد أفرزت الدراسة أن هذه البنوك تأخذ بالتعويض عن الضرر في شكل التصدق الإلزامي، وهي بهذا الالتزام توافق في عملها هيئة الفتاوى الشرعية. نتائج الدراسة تؤكد على منع التعويض؛ لأنه زيادة يصعب فصلها عن الربا. Abstract: This study seeks to sedh hight on compeusition for damage from the prespective of the objectives of preserving money and consideration of the money in islamic banks in Algeria . this study follows the descriptive analijtical approoch in presenting and discussing the evideuce and objections to it . The importance lies in the fact that it adresses the issue of compeusiation for damage from a purposeful point of view. the practical reality of Algerian islamic banks was the subjectof the study . which took compeusiation for damage in from compulsory charity .The sharia fatwas braod agreed on this ; and the results of the study confirm the prohibition of compeusiation because it is an increase in money that is difficult to distwguish from usury.

الملخص: لما كان المال يعد جزءا من حياة الإنسان وفطرته، فقد جاء الإسلام ليعزز هذه الفطرة، عن طريق التشريعات التي تحفظ ماله وتعينه على أداء ما عليه وتحقق ما له، وتهتم بكل ما يقوي روابط المحبة والمودة والألفة بين الناس، حيث لم ينظر الإسلام إلى الفرد كوحدة مستقلة عن المجتمع، بل كونه مكملا للمجتمع ومربوطا به برباط المصالح المتبادلة. ويهدف هذا البحث إلى تسليط الضوء على الناحية الأخلاقية للمعاملات المالية، وبيان مدى ارتباط الإحسان بالمعاملات المالية، من خلال تعريفه، وعرض علاقة الإحسان بتصرفات الإنسان المالية المباحة والمحظورة، وكذلك التنمية الاقتصادية والاجتماعية، انتهاءا بعرض بعض التطبيقات الفقهية في عقود المعاملات، حيث توصل البحث إلى جملة نتائج أبرزها: أنه يمكن اعتبار الإحسان أساسا مناسبا تنبني عليه المعاملات المالية، حيث يحقق تطبيقه ضمان استقرار العقود والمعاملات بين الناس. ABSTRACT Money is considered a part of a person’s life and nature, Islam came to strengthen this nature, through legislation that preserves his money, helps him perform what he owes and achieves what is his, and is concerned with everything that strengthens the bonds of love, affection and familiarity between people, as Islam does not view the individual as a unit. Independent from society, but rather being complementary to society and linked to it by mutual interests. This research aims to shed light on the ethical aspect of financial transactions, and explain the extent to which charity is related to financial transactions, through its definition, and presenting the relationship of charity to permissible and prohibited financial human actions, as well as economic and social development, ending with a presentation of some jurisprudential applications in transaction contracts, where the research reached the following conclusions: A number of results, the most notable of which are: that charity can be considered an appropriate basis upon which financial transactions are built, as its application ensures the stability of contracts and transactions between people.

الملخص: تهدف هذه الدراسة إلى إثبات جدارة التراث اللغوي العربي، وثرائه المنهجي الذي يقارب المناهج المعرفية الغربية، وذلك من خلال مقاربة المنهج التداولي السياقي لابن عاشور في تفسيره التحرير والتنوير، وتوظيفه لمجموعة من الإجراءات التداولية، والوظيفية كاستنباط المقاصد، وتجلية المعاني، وتتبع الاستراتيجيات، وتطبيقها على سورة البقرة نموذجا. وخلصت الدراسة إلى تثمين عمل ابن عاشور التفسيري، واستثمار أدواته المعرفية، ومقارباته التداولية ضمن مشروع تشكيل نظرية لسانية تداولية عربية تستلهم التراث، وتوظف الدراسات اللغوية الحديثة. This study aims to demonstrate the merit and methodological richness of the Arabic linguistic heritage, which parallels Western cognitive approaches. It does so through examining Ibn Ashur's pragmatic and contextual method in his Tafsir (Al-Tahrir wa Al-Tanwir), highlighting his use of pragmatic and functional procedures such as deriving purposes, clarifying meanings, tracing strategies, and applying them to Surah Al-Baqarah as a model. The study concludes by valuing Ibn Ashur's interpretative work, utilizing his cognitive tools and pragmatic approaches as part of a project to form an Arabic pragmatic linguistic theory that draws inspiration from heritage and employs modern linguistic studies.

الملخص: تعد العقود المركبة إحدى إفرازات المدنية الحديثة وتداعياتها على المنظومة العقدية في الفقه الإسلامي، خاصة فيما يتعلق بالعقود المستحدثة والمعاملات المالية المعاصرة، وتهدف هذه الدراسة إلى إبراز الأسس والمبادئ التشريعية التي تستند إليها فكرة تركيب العقود والجمع بينها في الفقه الإسلامي، وإبراز أثر تلك الأسس في إضفاء المشروعية على تلك العقود من خلال بيان مفهوم العقود المركبة وسماتها، وبيان الأسس التي تستند إليها هذه العقود، كحرية التعاقد وفقه المخارج الشرعية، والمصلحة والعرف وصولا إلى نتائج البحث والتي من أهمها استناد العقود المركبة إلى الأسس والمبادئ التشريعية التي تم ذكرها في ثنايا الدراسة وتوصياته بإيلاء الباحثين والدارسين جوانب من موضوع الدراسة باهتمامهم البحثي كضوابط العقود المركبة ومقاصدها ومجالاتها وتطبيقاتها المعاصرة. Complex contracts are one of the products of modern civilization and their repercussions on the contractual system in Islamic jurisprudence, especially concerning new contracts and contemporary financial transactions. This study aims to highlight the legislative foundations and principles upon which the idea of combining contracts in Islamic jurisprudence is based. It also aims to highlight the impact of these foundations in legitimizing such contracts by explaining the concept of compound contracts and their characteristics, as well as stating the principles on which these contracts rely, such as contractual freedom, understanding of legitimate exits, interest, and custom, leading to the research results, among the most important, include: the reliance of compound contracts on the legislative foundations and principles mentioned in the study, and recommending researchers and scholars to pay attention to aspects of the study topic in their research, such as the regulations of compound contracts, their objectives, fields, and contemporary applications.

الملخص: ملخّص: إنّه لا يخفى على كلّ ذي لبّ قويم الجهد الجبّار الذي قام به علماء الحديث في تأسيس منهجهم النّقدي؛ في مجالي الرّواية والدّراية، حتى بات علما على النّقاد الأفذاذ إذ لا يقدر عليه أي أحد، وقد جعله الله تعالى حافظا لسنّة نبيّه صلى الله عليه وسلّم من الضّياع، ومن الدّخيل وكذا من القصور في الفهم، لذلك كان لزاما على أعداء الإسلام أن يتهجّموا على هذا المنهج حتّى يتمكّنوا من الخوض في السّنة، وللأسف الشّديد قد تأثر بهم الكثير من بني جلدتنا، فباتوا ناشرين للأغاليط تحت جهل مركّب بهذا العلم ومنهجه، وعليه سيتمّ تبيين سمات هذا المنهج والردّ عن بعض تلك الشّبهات المثارة. Abstract: It is evident to everyone with discernment the tremendous effort exerted by the scholars of hadith in establishing their critical methodology in the fields of narration and knowledge. It has become a science mastered by distinguished critics, beyond the reach of just anyone. Allah, in His wisdom, made it a guardian of the Sunnah of His Prophet, protecting it from loss, distortion, and deficiencies in understanding. Hence, it became necessary for the enemies of Islam to attack this methodology in order to delve into the Sunnah. Unfortunately, many among our own people have been influenced by them, becoming disseminators of falsehoods due to a complex ignorance about this science and its methodology. However, the people of truth will prevail, clarifying the characteristics of this methodology and responding to some of those misconceptions.

الملخص: لا ريب أنّ مسألة الثّبات والتّغيّر في الفقه السّياسي من القضايا ذات الأهمّية البالغة والتي تقتضي بذل الوسع في دراستها واستفراغ الطّاقة في تحريرها، لتقديم رؤية متوازنة تعين الأمّة على العيش سياسيا في ظلّ عقيدة الإسلام وشريعته؛ ذلك أنّ الفقه السّياسي بحاجة إلى تجديد كثير من قضاياه في ظلّ الأوضاع الرّاهنة ليستعيد جدّته، وينفض ما تراكم على أحكامه من غبار الرّكود الفكري الذي ساد ساحته منذ أمد طويل، وليكسر أغلال التّقليد التي تقيّد بها بعض الفقهاء ممّن يتحدّثون في الشّأن العامّ، وليدفع ما وجّهه إليه أعداؤه وخصومه من تُهَم الجمود والقصور عن ملاحقة تطوّرات الحياة السّياسية داخليا وخارجيا. هذا ولمّا كانت الحاجة ماسّة إلى دراسة تأصيلية وتشريعية لهذا الموضوع فقد جاءت هذه الدّراسة الموسومة بعنوان: "تطوّر الفقه السّياسي، مجال وجدال"، لتقف على مدى أهمّية الموضوع ومجاله، والجدل القائم حوله، وتحديد الأسباب الدّافعة إلى هذا التّطوير، مع بيان الأسس الواجب مراعاتها أثناء ذلك، وكذا تتبّع سيرورة هذا التّطوّر ومظاهره. There is no doubt that the issue of constants and variables in political jurisprudence is one of great importance, which requires extensive efforts in studying it and understanding its meanings, to provide a balanced vision that helps the nation to live politically under the doctrine of Islam and its Sharia; political jurisprudence needs to renew many of its provisions in light of the current situation in order to restore its vitality, and to shake off what has accumulated on its rulings from the intellectual stagnation that has dominated its arena for a long time, and to break the tradition by which some jurists limited themselves to speaking in public affairs, and to distance themselves from the accusations of rigidity and failure to keep pace with the developments of political life both internally and externally. Since there is an urgent need for a fundamental and legislative study of this topic, this study, titled: "The Evolution of political jurisprudence (Domain and Disputation)" aims to explore the significance of the topic and its scope, the ongoing debate surrounding it, and to identify the reasons driving this development, while outlining the principles that must be observed in this regard, as well as tracing the process and manifestations

الملخص: يُبرز النص الروائــي الطيبـــاوي تجليات التلقي التي أعادت للقارئ مكانته واعتباره عند الكاتب إذ أصبح القارئ مشاركا حقيقيا بفعل قراءة النص الذي جاد تشاركيا بالكثير من المضامين والقضــايا المتعلقـــــــــة بالكاتب والقارئ. في مجتمع تربطه شريعة واحدة وبيئة ونمط حياة اجتماعية مشتركة، قراءة يتلقاها القارئ من كاتب أرسل رؤيته لواقعه الاجتماعــي في عديد الصـــورالنصية كتصوير لما عانى منه المثقف جراء الخيبات، علاقات صدامية تصادمية مع الذات والمحيط من خلال البنى الدلالية المضمونية لكلية النص، المهيمنة على فضائه الدلالي الروائي في إطار قراءة يتشاركها الكاتب مع قارئه لعالم مرجعي يكاد يكون موحدا. Ahmed Taibaoui's narrative text explores the dynamics of reception, emphasizing how it redefined the reader's role and re-established mutual respect between writer and reader. The reader emerges as an active participant, engaging with a text that addresses shared themes and concerns between both parties. Set within a society governed by uniform laws, shared environments, and a common social lifestyle, the text reflects the writer's vision of social reality through vivid imagery. It portrays the struggles intellectuals face, stemming from disillusionment and conflicting relationships with both self and surroundings.These challenges are expressed through the text's semantic and narrative structures, which dominate its thematic and spatial coherence. The writer invites the reader into a unified frame of reference, fostering a shared understanding of a collective reality.
