Ashes Of Justice: The Collapse Of International Humanitarian Law In Gaza

Abstract
In this contribution, we critique the failures of international humanitarian law (IHL) during the Gaza War, focusing on the documented violations of humanitarian norms and the insufficiency of existing legal protections. The study addresses the gap between law and conduct and examines why international law failed to protect civilians effectively. Using a critical analytical approach, it reviews international instruments, official documents, and reports in order to assess recorded violations and evaluate the effectiveness of international protection mechanisms. The study concludes that the absence of credible accountability mechanisms for IHL violations, combined with weak global political will to prosecute such crimes, has led to a near-complete breakdown of the IHL enforcement system developed through treaties. From this perspective, the paper underscores the urgency of reconsidering implementation and enforcement tools and of introducing international redress instruments to strengthen measures guaranteeing the protection of the civilian population in armed conflicts.
