أحكام الاستقالة في نظام العمل السعودي

الملخص

تهدف هذه الورقة البحثية، باستخدام المنهج الوصفي التحليلي، إلى تحليل الإطار القانوني للاستقالة في نظام العمل السعودي، مستعرضةً التوازن بين حق العامل في إنهاء العقد وحماية مصالح صاحب العمل. تتناول الدراسة الطبيعة القانونية للاستقالة، إجراءاتها وآثارها كفترة الإنذار والمستحقات المالية، والحالات الخاصة مثل فترة التجربة والاستقالة الحكمية بموجب المادة (81)، بالإضافة إلى دور القضاء العمالي في ترسيخ المبادئ ذات الصلة. وقد خلص البحث إلى أن المنظم كفل الاستقالة كحق مقيد بضوابط إجرائية وموضوعية، مع توفير ضمانات لحماية العامل، أبرزها الحق في العدول والاستقالة الحكمية. ويوصي البحث بتعزيز الوعي القانوني لدى طرفي علاقة العمل، وتطوير السياسات الداخلية للمنشآت، وتحديث بعض النصوص التنظيمية لتواكب التطورات العملية والقضائية. Employing a descriptive-analytical methodology, this paper analyzes the legal framework for resignation under Saudi Labor Law, examining the balance between an employee's right to terminate the contract and the protection of the employer's interests. The study reviews the legal nature of resignation, its procedures and consequences such as notice periods and financial dues, and special cases including the probationary period and constructive resignation under Article (81), in addition to the labor judiciary's role in consolidating relevant principles. The research concludes that the legislator has guaranteed resignation as a right regulated by procedural and substantive controls, while providing safeguards to protect the employee, notably the right of withdrawal and constructive resignation. The paper recommends enhancing legal awareness for both parties, developing internal corporate policies, and updating specific regulations to align with practical and judicial developments.
