الخصوصية الإجرائية لسير الدعوى العمومية في جرائم الإتجار بالبشر- دراسة تحليلية للقانون 23/04.

الملخص
إن تطور المنظومة الإجرامية استهدف بشكل مباشر الكيان البشري الذي أصبح محل أطماع عصابات ومنظمات الإتجار بالبشر قصد تحقيق الثراء الفاحش. وقد ظهرت بوادر الجهود الدولية لمحاربة هذه الظاهرة الإجرامية بوضع بروتوكول يفيد بمنع ومعاقبة الإتجار بالبشر من طرف هيئة الأمم المتحدة والذي صادقت عليه الجزائر بتحفظ سنة 2003, كما جرمت بشكل صريح هذه الجريمة بموجب نصوص الدستور وكذا قانون العقوبات إلى غاية سنة 2023 أين تم تبني قانون خاص 23/04 المتضمن الوقاية من الإتجار بالبشر ومكافحته, فجاء هذا القانون بمنظومة إجرائية مختلفة خاصة فيما يتعلق بسير الدعوى العمومية الناشئة انطلاقا من مرحلة التحري والاستدلال وصولا إلى مرحلة المحاكمة The evolution of the criminal system has directly targeted the human entity, which has become the subject of greed of human trafficking gangs and organizations in order to achieve exorbitant wealth. The signs of international efforts to combat this criminal phenomenon have emerged with the development of a protocol that calls for the prevention and punishment of human trafficking by the United Nations, which Algeria ratified with reservations in 2003. This crime was also explicitly criminalized under the provisions of the Constitution and the Penal Code until 2023, when a special law 23/04 was adopted, which includes the prevention and combating of human trafficking. This law came with a different procedural system, especially with regard to the conduct of public proceedings arising from the investigation and inference stage to the trial stage.
