رخصة البناء بين الحاجة إلى التوسع العمراني ومتطلبات الحفاظ على الأراضي الفلاحية

الملخص
أصدر المشرّع الجزائري منظومة من القواعد القانونية الأساسية لتنظيم عمليات الإنتاج والبناء الحضري، وذلك في إطار رؤية ترتكز على إدارة اقتصادية فعّالة ومستدامة للأراضي، وتهدف هذه القواعد إلى تحقيق نوع من التوازن بين مختلف أنماط الملكية العقارية، من خلال ربط سياسات التهيئة والتعمير بمخططات التوسع العمراني، مع الالتزام الصارم بالضوابط المتعلقة بالبناء على الأراضي الزراعية، بما ينسجم مع الاستراتيجيات الوطنية للتنمية والإعمار. وفي هذا السياق، يُعد الحصول على رخصة البناء خطوة إجرائية أساسية لا يمكن تجاوزها، لما لها من دور محوري في ضبط ومراقبة الأنشطة العمرانية، كما يُمنح المستثمر الفلاحي المستفيد من الامتياز الحق في إقامة المنشآت والتجهيزات الضرورية، شريطة الحصول على ترخيص من مديرية أملاك الدولة المختصة إقليمياً، مع ضرورة توفر ترخيص مسبق من الديوان الوطني للأراضي الفلاحية،ويأتي هذا التقييد القانوني بهدف تحقيق توازن مدروس بين الحفاظ على الإنتاجية الزراعية للأراضي المستثمرة وضمان استغلالها بطريقة أكثر كفاءة وفعالية. The Algerian legislator has issued a set of basic legal rules to regulate urban production and construction processes, within the framework of a vision based on effective and sustainable economic land management. These rules aim to achieve a kind of balance between the various types of real estate ownership, by linking development and construction policies with urban expansion plans , While strictly adhering to regulations related to construction on agricultural land, in line with national development and reconstruction strategies. In this context, obtaining a building permit is an essential procedural step that cannot be overlooked, given its pivotal role in regulating and monitoring urban activities .The agricultural investor benefiting from the concession is also granted the right to establish the necessary facilities and equipment, provided they obtain a license from the regionally competent State Property Directorate. Prior licenses must also be obtained from the National Office of Agricultural Lands. This legal restriction aims to achieve a well-thought-out balance between preserving the agricultural productivity of the invested lands and ensuring their exploitation in a more efficient and effective manner.
