The study aimed at exploring the definition, rights and ruling of prisoners of war in the light of International Humanitarian and Islamic Laws. The study administered the descriptive analytical approach. A review of literature was conducted. The study came to the findings that first, the international humanitarian law limits the definition of the prisoner of war to whoever captured at the time of wars, but the Islamic Law does well by broadening this definition to include whosoever captured in time of peace as well as long as the animosity between the rival nations or countries is going on; second, the international humanitarian law prescribes that the prisoners of wars have to be released and returned to their countries as soon as the war ends. This contradicts with what the Islamic Law decides. According to Islam, the president of the Muslim country is entitled to decide what should be done with the prisoners of war taking into consideration the public good and this is the most prudent since it meets the interest of the Muslim nation and the prisoners of war as well. The study recommends that; first, the international humanitarian law ought to expand the definition of the prisoner of war to include whosoever declares themselves the enemy of a given country or a nation at the time of war and the time of peace; second, empowering the presidents of countries to deal with the prisoners of war in the light of and in accordance with the teachings of the heavenly established religions of their countries or their national laws if the former is not available.
