حقوق الإنسان بين الإعلانات الدولية وأحكام الشريعة الإسلامية: تعارض أم تكامل؟human Rights Between International Declarations And The Provisions Of Islamic Sharia: Conflict Or Complementarity?

الملخص

يتناول هذا المقال العلاقة بين منظومة حقوق الانسان كما كرستها الاعلانات والمواثيق الدولية، وما اقرته الشريعة الاسلامية من حقوق وضمانات للانسان عبر تاريخها التشريعي الثري. تنطلق الدراسة من اشكالية جوهرية: هل ثمة تعارض حقيقي بين المنظومتين ام ان التباين في المرجعيات لا يحول دون التكامل في المضامين؟ اعتمد البحث المنهج المقارن التحليلي مستعينا بمصادر الفقه الاسلامي والوثائق الدولية لحقوق الانسان. خلصت الدراسة الى ان الشريعة الاسلامية سبقت الاعلانات الدولية في تكريس جملة من الحقوق الاساسية، وان مواطن التباين تعود في جوهرها الى الاختلاف في الاطر المرجعية لا الى تناقض في المحتوى الانساني. وتوصي الدراسة بصياغة خطاب حقوقي اسلامي معاصر يجمع بين اصالة الشريعة ومتطلبات الحوار الدولي. . This article examines the relationship between the human rights framework established by international declarations and conventions, and the rights and guarantees enshrined in Islamic Sharia through its rich legislative history. The study departs from a fundamental question: is there a genuine conflict between the two systems, or does the difference in their foundational references not preclude complementarity in substance? The research employs a comparative analytical methodology drawing on Islamic jurisprudential sources and international human rights instruments. The study concludes that Islamic Sharia preceded international declarations in enshrining several fundamental rights, and that areas of divergence stem essentially from differences in normative frameworks rather than contradictions in humanitarian content. The study recommends formulating a contemporary Islamic human rights discourse that combines the authenticity of Sharia with the requirements of international dialogue.
