الملخص
تهدف الدراسة إلى الوقوف عند حدود الدور الذي تؤديه المحكمة الافريقية لحقوق الانسان والشعوب في حماية حقوق الإنسان على مستوى القارة الافريقية ومدى فعاليته، على اعتبار أنها تمثل أهم هيئة قضائية إقليمية تصدر قرارات ملزمة، وبعد تحليل الموضوع تحليلا علميا وأكاديميا توصلت الدراسة إلى أنه ورغم الجهود المبذولة من أجل العمل على تحسين أداء المحكمة، إلا أنه ونظرا لسيطرة الاعتبارات السياسية على عملها تظل عاجزة عن حماية حقوق الانسان بالشكل المنشود. This study aims to examine the effectiveness of the role played by the African Court on Human and Peoples’ Rights in protecting human rights across the African continent, considering that it represents the most prominent regional judicial body issuing binding decisions. The study concludes that despite the efforts made to improve the Court’s performance and enhance its capabilities, the dominance of political considerations over its functioning continues to constitute a major obstacle to achieving effective and comprehensive protection of human rights in the continent. As a result, the Court’s performance remains below the desired expectations
