This study examines the problematic of the Right to be Forgotten as a newly developed safeguard for privacy protection under Law No. 18-07 related to the protection of individuals in the processing of personal data. The significance of this research lies in its attempt to reconcile the perpetuity of digital archiving with Algerian constitutional principles that consecrate the sanctity of private life and the humanization of punishment. The study concludes that the Algerian legislator, by establishing the National Authority for the Protection of Personal Data, has laid the foundation for individual informational sovereignty. This framework provides individuals with procedural mechanisms—such as the rights to object, erasure, and de-indexing—to combat what is known as digital stigma. The criminal specificity of this right emerges as a digital extension of the rehabilitation system; criminal reform remains incomplete if a prior criminal record continues to haunt a convicted individual via search engines despite the legal expiry of their sentence. The study recommends the necessity of enhancing judicial specialization in digital disputes and activating international cooperation to compel transnational technology companies to respect the sovereign decisions issued by the National Authority. This aims to achieve a balance between the right to information and the right to turn the page on the past, fostering a renewed digital identity that preserves individual dignity and social tranquility.
