الحق في النسيان الرقمي (المفاهيم وآليات الحماية)

الملخص
أدى تحول العالم نحو الرقمنة إلى إحداث العديد من التغيرات تحت تأثير تكنولوجيا المعلومات، حيث تغيرت الحقوق الأساسية بشكل كبير في نطاقها ومعناها، وتشكلت حقوق جديدة لم تكن واضحة من قبل، على غرار الحق في النسيان الرقمي الذي فرضته ضرورة حماية الهوية الرقمية لمستخدمي الأنترنت من المخاطر الناتجة عن القدرات المتزايدة لتكنولوجيا المعلومات في معالجة وتخزين البيانات لمدة زمنية غير معلومة. وقد حضي هذا الحق باهتمام قانوي بالغ، وأثار الكثير من الجدل والنقاش- في أوروبا خاصة- وكان موضوعا للكثير من البحوث القانونية، على غرار بحثنا الذي تعرض لجانب مهم من الجوانب المتعلقة بالحق في النسيان الرقمي، فتمت دراسته من حيث المفهوم، التكريس القانوني، بالإضافة إلى الآليات المقررة لحمايته وتفعيله، وتوصلنا من خلال ذلك إلى ضرورة التكريس القانوني لهذا الحق كحق مستقل مع الموازنة بينه وبين الحقوق المتضاربة معه، حتى يكون قادرا على حماية هوية الأفراد وبياناتهم الرقمية. Abstract : The world's shift toward digitization has led to numerous changes driven by information technologysignificantly altering the scope and meaning of fundamental rights and giving rise to new rights that were previously unclear. One such right is the right to be forgotten, which has emerged from the need to protect users' digital identities from the risks posed by the increasing capabilities of information technology to process and store data for indefinite periods. This right has garnered considerable legal attention and sparked much debate -particularly in Europe- and has been the subject of many legal studies, including our own. Our research examined a key aspect of the right to be forgotten, analyzing its concept, legal recognition, and the mechanisms established for its protection and implementation. Through this analysis, we concluded that it is essential to legally establish this right as an independent right while balancing it against other conflicting rights, so that it can effectively safeguard individuals' identities and digital data.
