Cyberbullying Between The Sufficiency Of Traditional Criminal Provisions And The Necessity Of Legislative Innovation: An Analytical Approach In Algerian Criminal Law

Authors : Lassoued Moussa . Hafdallah Abdellali .

Abstract

Abstract : This research addresses the phenomenon of Cyberbullying as an emerging crime resulting from the misuse of information and communication technologies, with a focus on the Algerian legal system. The study aims to evaluate the adequacy of traditional penal codes such as defamation, harassment, and blackmail in addressing cyberbullying against vulnerable groups, particularly women and children. The study concludes that while Cyberbullying is not explicitly defined in Algerian legislation, general penal provisions provide partial protection. This necessitates legislative intervention to enact specialized laws that keep pace with rapid technological advancements and ensure comprehensive protection for victims in virtual spaces.
