قاعدة الأمور بمقاصدها وتطبيقاتها الفقهية على نقل الأعضاء وزرعها

الملخص
ملخص يُعرّفُ البحث بإحدى القواعد الفقهية الكبرى، وهي قاعدة: "الأمور بمقاصدها"، مبيّناً دليلها، وأهميتها، كما يُعرف بعمليّة زرع الأعضاء وصورها وحكمها الفقهيّ، ومسالك الاستدلال عليها، ويُعالج بعد ذلك أثر هذه القاعدة الفقهيّة وما تفرّع عنها على نازلة نقل الأعضاء وزرعها، وخَلُص البحث إلى أنّ قاعدة "الأمور بمقاصدها" تُسهم في ضبط عمليّة نقل الأعضاء وزرعها وَفْقَ الشُّروط التي نصَّ عليها الفقهاء المعاصرون، وتُعالج مسألة نقل الأعضاء وزرعها من أبعاد ثلاثة؛ بُعْد روحيّ إيماني، وبُعْد أخلاقيّ سلوكيّ، وبُعْد زجريّ عقابي. Abstract The article determines one of the major islamic jurisprudence principles i.e « matters are evaluated based on their purposes » highlighting its proofs, importance and different methods of inference. It also defines the operation of organ transplantation and its different forms, its jurisprudence and ways of proving. It then treats the impact of the above mentioned principle and its derivatives on the current issue of organ transfer and transplantation. It concludes that this rule contributes to regulate the operation of organ transfer and transplantation according to the conditions prescribed by comtemporary scholars. The article treats this new matter from 03 dimensions i.e faith and spiritual, behavioral punitive and injunctive dimensions.
