The Role Of Customs Criminal Policy In Enhancing Legal Certainty For Investment In Algerian Legislation

Abstract
This study aims to highlight the role of customs criminal policy in enhancing legal certainty for investment under Algerian legislation by analyzing the specific features of criminalization and punishment in customs matters as mechanisms for protecting the economic system and ensuring transparency in trade transactions. The study demonstrates that the Algerian legislator has adopted a flexible punitive framework primarily based on financial penalties such as fines and confiscation, alongside custodial sanctions in serious cases, while also promoting customs reconciliation as an alternative mechanism for dispute settlement and for reducing legal risks associated with economic activity. It concludes that an effective customs criminal policy contributes to strengthening the stability of the legal environment and enhancing investment attractiveness.
