الملخص
ملخص: يعد تغير المناخ اليوم قضية وجودية للبشرية، وقد لوحظت بالفعل آثار مناخية خطيرة على جميع أنحاء العالم؛ إن الآثار المناخية الأكثر خطورة حتمية الوقوع ما لم تُتخذ إجراءات أكثر فعالية، كما خلصت إليه عدة تقارير دولية. أصدرت محكمة العدل الدولية في 23 جويلية 2025، رأيا استشاريا بشأن الالتزامات القانونية للدول فيما يتعلق بتغير المناخ، ويؤكد هذا الرأي أن انتهاك الالتزامات المتعلقة بالمناخ يعد فعلا غير مشروع دوليا، مما يعني أن الدول تتحمل مسؤولية التصدي لتغير المناخ. تقدم هذه الدراسة تحليلا للرأي الاستشاري، وتدرس أهميته، أسسه القانونية، مضمونه، وآثاره على القانون الدولي؛ ومع أن الرأي الاستشاري الصادر عن محكمة العدل الدولية غير ملزم، إلا أنه يسهم في توضيح القانون الدولي وتطويره. Abstract: Climate change is now an existential issue for humanity. Serious climate impacts have already been observed on every in many parts of the world. Far more dangerous climate impacts are inevitable without much stronger action, as several international reports concluded. On 23 July 2025, the International Court of Justice (ICJ) issued an advisory opinion concerning the legal obligations of States in respect of climate change. The opinion affirms that breaches of climate-related obligations constitute internationally wrongful act, thereby holding that states have a responsibility to tackle climate change. This study offers an analysis of the opinion, examining its importance, legal foundations, Content, and implications for international law. While an advisory opinion of the International Court of Justice is not binding, it contribute to the clarification and development of international law.
