الملخص
ملخص: تسعى هذه الدراسة إلى تسليط الضوء على العقوبات التي اتخذتها الولايات المتحدة الأمريكية ضد قضاة ومسؤولي المحكمة الجنائية الدولية، كإجراء أحادي ردا على جهودهم بفتح تحقيقات أو إصدار أوامر قبض، لا سيما ما تعلق منها بالحالة في أفغانستان أو فلسطين. وقد أثار فرض هذه العقوبات ردود فعل عالمية، لا سيما من قبل المحكمة الجنائية الدولية معتبرة أنها محاولة لتقويض استقلاليتها؛ وفي هذا الصدد، يصطدم فرض مثل هذه العقوبات ضد مسؤولي المحكمة مع مبادئ وأحكام القانون الدولي لعل أهمها استقلالية المحكمة وسيادة القانون، من جهة، كما أن تنفيذ أوامر القبض وقرارات المحكمة يقع على عاتق الدول الأطراف في المحكمة من جهة أخرى. Abstract: This study highlights U.S sanctions against judges and officials of the International Criminal Court’s (ICC), as a unilateral measure in response to their efforts to open investigations or issue arrest warrants, particularly those related to the situation in Afghanistan or Palestine. The imposition of these sanctions has sparked Worldwide Reactions, particularly from ICC, which considers them an attempt to undermine its independence. In this regard, the imposition of such sanctions against court officials conflicts with the principles and provisions of international law, the most important of which are the independence of the court and the rule of law, on the one hand, and the fact that the implementation of arrest warrants and court decisions is the responsibility of the states parties to the court, on the other.
