الترجيح المقاصدي عند العلامة محمد الطاهر ابن عاشور

الملخص

يعد الترجيح المقاصدي من المسائل المهمة في علم أصول الفقه، حيث يتناول دراسة طرق ترجيح الأدلة بناءً على مقاصد الشريعة الإسلامية. ويُعتبر الطاهر ابن عاشور من رواد المدرسة المقاصدية في الفكر الإسلامي الحديث، الذين أولوا عناية كبيرة لمقاصد الشريعة في استنباط الأحكام الشرعية وترجيحها. وتهدف هذه الورقة البحثية إلى تسليط الضوء على منهجية الترجيح المقاصدي عند الطاهر بن عاشور، مع بيان أسسه وطرقه وتطبيقاته في الفقه الإسلامي. وذلك من خلال إشكالية مركزية: كيف وظّف ابن عاشور مقاصد الشريعة للترجيح بين الأدلة الشرعية ؟ وقد خلصت الورقة إلى مجموعة من النتائج أهمها أنّ الإضافات النّوعية لابن عاشور في علم مقاصد الشريعة كانت فتحا غزيرًا ومنهجًا إضافيًا للترجيح بين الأدلة الشرعية والوصول إلى المراد الإلهي. Purpose-based juristic preference (Tarjeeḥ al-Maqāṣid) is a crucial topic in Islamic legal theory (uṣūl al-fiqh), focusing on the methodologies of prioritizing legal evidence based on the higher objectives (maqāṣid) of Islamic law (sharīʿah). Al-Ṭāhir ibn ʿĀshūr is regarded as a pioneer of the maqāṣid school in modern Islamic thought. He placed significant emphasis on the objectives of Islamic law in deriving and prioritizing legal rulings, making him a key figure in this field. This research paper aims to shed light on the methodology of purpose-based juristic preference (Tarjeeḥ al-Maqāṣid) employed by al-Ṭāhir ibn ʿĀshūr, elucidating its foundations, methods, and applications in Islamic jurisprudence. It addresses a central question: How did ibn ʿĀshūr utilize the objectives of Islamic law (Maqāṣid al-Sharīʿah) to prioritize among legal evidences? The researcher concludes with several key findings, most notably that ibn ʿĀshūr’s qualitative contributions to the science of Maqāṣid al-Sharīʿah were a significant breakthrough and an additional methodology for prioritizing legal evidences and attaining the divine intent.
