قاعدة سد الذرائع وأثرها في تصرفات المحتسب في نظام الدولة الإسلامية

الملخص
ملخص البحث قاعدة سد الذرائع من أهم القواعد في الشريعة الإسلامية، وتطبيقاتها في الأحكام الشرعية كثيرة عند فقهاء المسلمين قديما وحديثا، وقد كثرت البحاث حول هذه القاعدة من جانب استعمالاتها عند الفقهاء في الأحكام الشرعية، وقد تبين أن الجانب التنظيمي في الدولة الإسلامية يقتضي أن يعمل المحتسب بهذه القاعدة في نفسه أولا فيضبط تصرفاته حتى لا يغير منكرا بمنكر آخر، ثم في أهل الأسواق حتى يضبط تصرفاتهم فلا تؤول إلى مفاسد في دينهم أو دنياهم، على مستوى الفرد أو الجماعة، وقد توصلنا في هذا البحث إلى أن الموظف المحتسب في الدولة الإسلامية، كان يجمع بين الخبرة في وظيفته وبين النظر الفقهي الشرعي، مما أعطى هذه وظيفة الحسبة قيمتها التاريخية والحضارية. And it turns out that the organizational aspect of the Islamic State requires the accountant to act on this rule first and adjust his actions so as not to change the denial of another denier, Then in the people of the markets until they control their actions, do not become corrupt in their religion or their inferiority. at the level of the individual or group, and we have found in this research that the official accounted for in the Islamic State s legal doctrine, which gave this function of computerization its historical and civilizational value.
