الملخص
ملخص البحث: يعد الموقف السياسي والفتوى السياسية للفقيه من أصعب الأمور، خاصة إذا اشتدت أحداث الواقع التاريخي المعيش، وتسارعت التحولات السياسية الخطيرة، وعظمت الفتن من الداخل والخارج، حينئذ يتحتم على الفقيه أن يصرح بما يسهم في الخير والإصلاح، وهو ما ينتظره منه جمهور الناس، ولا يكون الفقيه موفقا في هذا إلا إذا تمكن من علم الفقه وضبط قواعد الشريعة، موازاة مع فقه الواقع فقها تاما، وهذا البحث يحاول إبراز هذه القضية المهمة جدا، وقد توصل إلى مجموعة من النتائج أبرزها أن الغزالي كان فقيها عظيما وأصوليا كبيرا، وهو ما جعله ينتج فكرا سياسيا أصيلا بني على أسس قوية، ولم يكن مناصرا للسلطة كما قد يبدو لبعض الباحثين، وإنما كان يعتمد على الفقه وضوابط التشريع، وروح الشريعة الإسلامية في بناء فكره السياسي، وقد اعتمدت في تحقيق هذه النتائج على المنهج التاريخي والمنهج التحليلي والمنهج الاستنباطي. Research Summary: The political position and the political fatwa of the jurist is one of the most difficult things, especially if the events of the historical reality are intensified, serious political transformations are accelerated, and the sedition is magnified from within and outside, then it is imperative for the jurist to declare what contributes to good and reform, which is what the public expects from him, and the jurist is successful in this only if he is able to teach jurisprudence and adjust the rules of Sharia, in parallel with the jurisprudence of reality, fully, and this research tries to highlight this very important issue, and he has reached a set of results, most notably that Al-Ghazali he was a great jurist and a great fundamentalist, which made him produce an original political thought built on strong foundations, and he was not a supporter of power as it might seem to some researchers، Rather, he relied on jurisprudence, legislative controls, and the spirit of Islamic Sharia in building his political thought, and in achieving these results, I relied on the historical method, the analytical method, and the deductive method. )
