قاعدة الذرائع وأثرها في تحقيق مقاصد الشارع

الملخص
يتناول هذا المقال قاعدة من القواعد الشرعية المعنية "بتأطير" الاجتهاد ليكون واقعا في محلّه على وجه صحيح، والتأطير هنا يعني وضع قيود وضوابط للاجتهاد حتى لا يبتعد عن المسار القويم، لذلك اشتهرت القاعدة باسم:" سدّ الذرائع"، مع أن الذرائع مثلما يتوجب "سدها" أحيانا فإنه يلزم "فتحها" في أحايين أخرى، لذلك فضلت أن يكون العنوان بصيغته المطلقة:" قاعدة الذرائع"، وقد وضحت مفهوم ذلك في المطلب الأول. وأما المطلب الثاني: فكان عن أهمية النظر في مآلات الأفعال الذي هو من إبداعات الإمام الشاطبي وفيه تقعيد للاجتهاد الآخذ بعين الاعتبار ما تؤول إليه أفعال المكلفين من نتائج فيما يستقبل، إيجابية كانت أم سلبية. ثم كان من الأنسب أن يختم هذا المقال بمبحث يعالج الإفراط أو التفريط في موضوع الذرائع ليكون الرائد الاعتدال والبعد عن طرفي التشدد أو الانحلال. This article discuss ( tackles) one if the Religeous principles that is meant to « framing » the studiosness to be used in its right form, and farming here means stating borders regulations as not to deviate from the right path. Therefore, this principles became known as " clogging the pretension " even though those pretensions should be prevented often, they also have situations in which they should be allowed. Thus, I prefferd its title rather to be in its absolute form « the principles of pretensions » and I have explained that in the first ( section / stage / segment / purpose / episode ) Concerning the second ( section / stage........) : it was about the importance of looking into the consequences of the deeds , which is one of the famous works of " El Imame Shatibi " , where there are rules made for studiousness taking in consideration what a sane person deeds may lead to, be its positive or negative So, it was better to end the article with a research that deals with the excessiveness and renunciation in the them of pretensions in order to reach the aim of mediation
