منازعة الانتخابات الرئاسية أمام المحكمة الدستورية الجزائرية

الملخص
الملخص: تعتبر العملية الانتخابية مصداقية الحكم الديمقراطي في الدولة، ويمثل الخلاف في ظلها الأساس الجوهري لدمقراطية الحكم السائد في صورة النزاع الانتخابي. حيث تعد المنازعة الانتخابية لمنصب رئيس الجمهورية ذات خصوصية منفردة عن المنازعات الإدارية بشكل عام، ومنازعة الانتخابات التشريعية والمحلية بشكل خاص لما تكتسبه من أساليب قانونية ناجحة. بهذا عرفت المنظومة القانونية للانتخابات الرئاسية الجزائرية تغييرا جذريا للإشراف العام على العملية الانتخابية وتنظيمها من خلال نقل جميع الصلاحيات من الإدارة (وزارة الداخلية) الى سلطة دستورية مستقلة بموجب التعديل الدستوري 2020. يرتكز هذا البحث بالأساس على تحليل القواعد الناظمة لممارسة وحماية الحق الانتخابي، والدور المحوري والقانوني للجهات المختصة للفصل وفض المنازعات الانتخابية القائمة خلال العملية الانتخابية. Abstract: The electoral process considers the credibility of democratic governance in the country, and disagreement within it represents the fundamental basis for the democracy of governance that exists in the form of electoral conflict. The Electoral Dispute for the Position of President of the Republic Is Different from Administrative Disputes in General, And Legislative and Local Election Disputes in Particular, Because of the Successful Legal Methods It Acquires. Thus, the Algerian Presidential Elections Legal System underwent a radical change in the general supervision and organization of the electoral process as a result of the transfer of all powers from the administration (Ministry of Interior) to an independent constitutional authority in accordance with the 2020 Constitutional Amendment. This research is primarily based on an analysis of the rules governing the exercise and protection of the electoral right, as well as the critical and legal role of competent authorities in adjudicating and resolving electoral disputes that arise during the electoral process.
