المنازعات الدستورية في القضاء الدستوري الجزائري بين دستور 1989 وتعديل 2020

الملخص
يتناول هذا المقال موضوع المنازعات الدستورية في القضاء الدستوري بالجزائر مع التركيز على تطور آليات حلها بين دستور 1989والتعديل الدستوري 2020 حيث نسلط الضوء على دور القضاء الدستوري في الفصل في النزاعات الدستورية ودراسة الاختلافات الجوهرية بين الدستورين من حيث صلاحيات المجلس الدستوري والمحكمة الدستورية وخاصة فيما يتعلق بالرقابة على القوانين والطعن بعدم الدستورية , و كيف ساهم تعديل 2020 في توسيع مجال تدخل القضاء الدستوري , وتعزيز حماية الحقوق والحريات الأساسية , مع التركيز على التغييرات التي طرأت على آليات حل هذه المنازعات في المحكمة الدستورية التي جاءت بديلاً عن المجلس الدستوري في تعزيز الرقابة الدستورية وضمان مبدأ سمو الدستور كما نناقش أقرار التعديل الجديد لآلية الطعن بعدم الدستورية مما سمح للمواطنين بالطعن في القوانين المخالفة للدستور أمام المحكمة الدستورية This article deals with the topic of constitutional disputes in the constitutional judiciary in Algeria, with a focus on the development of mechanisms for resolving them between the 1989 Constitution and the 2020 Constitutional Amendment. We highlight the role of the constitutional judiciary in resolving constitutional disputes and study the fundamental differences between the two constitutions in terms of the powers of the Constitutional Council and the Constitutional Court, especially with regard to monitoring laws and challenging unconstitutionality, and how the 2020 Amendment contributed to expanding the scope of intervention of the constitutional judiciary Strengthening the protection of fundamental rights and freedoms, with a focus on the changes that have occurred in the mechanisms for resolving these disputes in the Constitutional Court, which came as an alternative to the Constitutional Council in strengthening constitutional oversight and ensuring the principle of the supremacy of the Constitution. We are also discussing the approval of the new amendment to the mechanism for appealing unconstitutionality, which allowed citizens to appeal laws that violate the Constitution before the Constitutional Court
