The Positive Authority Of International Criminal Court Judgments Before The National Judiciary.

Authors : Zebiri Maria .

Abstract

Article abstract: The International Criminal Court (ICC) does not have the authority to initiate or directly interfere in the execution of its judgments, as this would encroach upon the sovereignty of states and constitute interference in their internal affairs. Nonetheless, the ICC can establish coordination and cooperation agreements with designated states to oversee and monitor the implementation of its judgments. In some cases, the ICC may delegate responsibility for enforcement to the internal judiciary of the concerned state. Prison sentences, however, may only be carried out within the territory of a state party if that state explicitly consents to receive the convicted individuals. In contrast, all states are obligated to enforce judgments involving financial penalties.
