الحماية القضائية للمستهلك في التشريع الجزائري Judicial Protection Of The Consumer In Algerian Legislation

الملخص
الملخص: صاحب تزايد المواد والسلع والخدمات المعروضة للاستهلاك بسبب التطور العلمي، ظهور رهيب للأمراض التي يمكن أن يتعرض لها مقتني هذه السلع والمواد والخدمات. لذلك سعى المشرع الجزائري على غرار التشريعات الأخرى إلى إحاطة المستهلك بحماية قانونية واسعة ، تأتي في مقدمتها : الحماية القضائية ، وذلك وفق آليات متعددة منها دعوى الضمان والتي تندرج ضمن الدعاوى المدنية، كما لم يغفل المشرع عن تجريم بعض الأفعال التي تمس بصحة المستهلك ضمن ما يعرف بالحماة الجزائية للمستهلك. Abstract: The increase in materials, goods and services offered for consumption due to scientific development has led to a terrible emergence of of diseases that may be exposed to the purchaser of these goods, materials and services. Therefore, the Algerian legislator, similar to other legislations, has sought to provide the consumer with broad legal protection, most notably: judicial protection, according to multiple mechanisms, including the warranty claim, which falls within civil lawsuits. The legislator has also not neglected to criminalize some acts that affect the health of the consumer within what is known as the criminal protection of the consumer.
