رقمنة الصفقات العمومية في التشريع الجزائري – البوابة الالكترونية نموذجا-

الملخص
ملخص: من الأساسيات التي تسعى دول العالم قاطبة إلى تحقيقها :تحسين الخدمة العمومية ، وذلك من منذ ظهور الدول بالمفهوم القانوني . ومع تزايد حاجات الفرد وانتقال مفهوم الدولة من حاكمة إلى حارسة، بات من الضروري تفويض العديد من الخدمات العمومية إلى أشخاص آخرين غير الدولة من أجل تلبية حاجات المواطن المتزايدة في شكل يرضيه. والآلية المعتمدة لتفويض ذلك هي الصفقات العمومية . من جهة أخرى كان لابد على الدولة في ظل التطور التكنولوجي الحاصل والذي من بين مفرزاته الإدارة لالكترونية، ونظرا لرغبة الأشخاص في الظفر بالصفقة العمومية وجب عليها تذليل الصعوبات أمام هؤلاء من جهة ومن جهة أخرى ضمان شفافية الصفقة العمومية، وقد تم تجسيد ذلك من طرف المشرع الجزائري بموجب المرسوم الرئاسي 10/236 المتضمن الصفقات العمومية الملغى وأد على ذلك بموجب المرسوم الرئاسي 15/247. أما بالنسبة لكل ما يتعلق بالبوابة الالكترونية من محتوى، وتسيير وكذا تبادل المعلومات بالطريقة الالكترونية فقد تضمنه القرار الوزاري الصادر بتاريخ 17/ 11/2013. Abstract : One of the basics that all countries of the world seek to achieve is: improving public service, since the emergence of states in the legal sense. With the increasing needs of the individual and the transition of the concept of the state from a ruler to a guardian, it has become necessary to delegate many public services to people other than the state in order to meet the increasing needs of the citizen in a way that satisfies him. The mechanism adopted for delegating this is public contracts. On the other hand, the state had to, in light of the technological development that has occurred, among its outcomes, electronic administration, and given the desire of individuals to win the public contract, it had to overcome the difficulties facing them on the one hand and on the other hand, ensure the transparency of the public contract, and this was embodied by the Algerian legislator by virtue of Presidential Decree 10/236, which included the repealed public contracts, and accordingly by virtue of Presidential Decree 15/247. As for everything related to the electronic portal, from content, management and the exchange of information electronically, it was included in the ministerial decision issued on 11/17/2013 Résumé : Lʾ un des objectifs fondamentaux que tous les pays du monde cherchent a atteindre est l’amélioration du service public. Ceci a été incarné par le législateur algérien dans le décret présidentiel 10/236, qui comprend: Les transactions publiques annulées sont basées sur cela. Décret présidentiel 15/247. Quant à tout ce qui concerne le portail électronique, y compris le contenu, la gestion et l'échange d'informations par voie électronique, cela a été inclus dans l'arrêté ministériel du 17/ 11/2013
