Abstract: Artificial intelligence is reshaping criminal justice, affecting both how crimes are committed and how they are investigated. This paper explores the dual role of AI from two interconnected perspectives. On one side, offenders exploit technologies such as deepfakes, algorithmic fraud, and chatbots to carry out crimes with growing sophistication. On the other, investigators employ the same tools—big data analytics, facial recognition, and voice identification—to enhance detection and expose offenders. Findings reveal a widening gap: criminals increasingly use advanced systems that outpace traditional investigative methods, leaving justice mechanisms struggling to adapt. This imbalance highlights the urgent need for legislative updates, both to criminalize AI-driven offenses and to regulate the evidentiary value of AI-generated materials, while safeguarding defense rights and the principles of a fair trial.
