الملخص
ملخص: يهدف هذا البحث إلى دراسة المسؤولية الجنائية للموظف العمومي عن الأفعال الإدارية في التشريع الجزائري، وذلك بتحديد الإطار القانوني الذي يحكم الوظيفة العمومية وأنواع المسؤوليات القانونية التي قد تترتب على أفعال الموظفين. يتناول البحث المسؤولية التأديبية والمدنية والجنائية للموظف، مع التركيز على الأخيرة لما لها من خصوصية تتعلق بالنظام العام وحماية المال العام. لقد توصل البحث إلى أن التشريع الجزائري وضع أسسا واضحة لمساءلة الموظف العمومي، حيث تتكامل هذه المسؤوليات لضمان حسن سير الإدارة وحماية حقوق الأفراد والمال العام. كما أظهرت النتائج وجود تحديات في التطبيق العملي تتطلب تعزيز آليات الرقابة والشفافية وتوحيد الاجتهاد القضائي لتحقيق العدالة والنزاهة في الجهاز الإداري. Abstract: This research aims to investigate the criminal liability of public officials for administrative acts within Algerian legislation. It defines the legal framework governing public service and identifies the types of legal liabilities that may arise from employees' actions. The study addresses the disciplinary, civil, and criminal responsibilities of public officials, with a particular focus on the latter due to its specific nature concerning public order and the protection of public funds. The research concludes that Algerian legislation has established clear foundations for holding public officials accountable. These integrated responsibilities ensure the proper functioning of public administration and safeguard individual rights and public funds. Furthermore, the findings indicate practical implementation challenges that necessitate enhancing oversight and transparency mechanisms, along with unifying judicial precedents to achieve justice and integrity within the administrative apparatus.
