الملخص

تتناول ورقتنا البحثية موضوع المعاملة الإلكترونية، حيث يشهد الوضع في الجزائر حاليًا تحولات جذرية من حيث تتابع صدور نصوص قانونية يسعى من ورائها المشرع الجزائري لاحتواء مخرجات التقنية أي الأدوات التقنية والرقمية الهادفة لا سيما تلك المتعلقة بالمعاملات الإلكترونية من أجل تعزيز الأمن القانوني للمعاملات، ولهذا بادر المشرع الجزائري بتحديث البيئة القانونية من خلال إصدار القانون رقم:26/06 ، حيث جاء بجملة من الإجراءات تعزز من المعاملة الإلكترونية، لاسيما من حيث إثباتها، بناءً على ذلك تهدف الدراسة من جهة إلى استعراض مفهوم المعاملة الإلكترونية حسب النصوص التشريعية المستجدة، وبيان وتحليل أهم تقنيات ووسائل إثبات حجية المعاملة القانونية من جهة أخرى، وقد خلصت الدراسة إلى أن اعتماد استحداث هذه الوسائل يُعد تدعيمًا للنظام الرقمي ولاستراتيجية التحول الرقمي في الجزائر، ومع ذلك لا تزال هناك تحديات قانونية تتطلب معالجة البنية التحتية لتجسيد هذه الآليات فضلًا عن معالجة أهم النقائص التي طالت القانون الجديد من أجل توفير إطار تشريعي محكم وبيئة تقنية آمنة. Our research paper addresses the topic of electronic transactions, The current situation in Algeria is undergoing radical changes, marked by a succession of legal texts through which the Algerian legislature seeks to regulate technological developments specifically technical and digital tools, particularly those related to electronic transactions in order to enhance the legal security of such transactions, For this reason, the Algerian legislature has taken the initiative to update the legal framework by enacting Law No. 26/06, which introduced a series of measures to promote electronic transactions, particularly regarding their authentication, Accordingly, this study aims, on the one hand, to review the concept of electronic transactions in light of the new legislative texts, and, on the other hand, to identify and analyze the most important technologies and means of establishing the legal validity of such transactions, The study concluded that the adoption of these new means strengthens the digital system and Algeria’s digital transformation strategy; However, legal challenges remain that require addressing the infrastructure to implement these mechanisms, as well as addressing the most significant shortcomings in the new law, in order to provide a robust legislative framework and a secure technical environment.
