The Algerian Legislative Position On Expropriation Of Investments: General Rule And Exceptions

Authors : Kameli Aicha .

Abstract

The Algerian lawmaker aimed to create an appropriate legal framework that would increase trust in Algerian law and attract investors, especially foreigners. Within this framework, a number of guarantees were granted, including the guarantee against the expropriation of foreign investment projects, which is considered an application of the constitutionally guaranteed right to private property, recognized in international conventions and agreements. Nonetheless, the state's right to reclaim property for reasons of public interest is unaffected by the constitutional and international acknowledgment of the right to private property as long as it is exercised within the legal conventions. Property is recovered in return for fair compensation that guarantees a proper reimbursement for any damages the investor may have suffered as a result of their investment project being expropriated.
