حاضنات الأعمال ومشاتل المؤسّسات مظهر للتّعدّد المصطلحيّ في التّشريع الجزائريّ أم مفهومان مختلفان ؟.

الملخص
بموجب المرسوم التّنفيذي 18 – 170 المحدّد لمهام وكالة تطوير المؤسّسات الصّغيرة والمتوسّطة وترقية الابتكار المُلغي للمرسوم التّنفيذي 03 – 78 المتضمّن القانون الأساسي لمشاتل المؤسّسات، أبقى المشرّع الجزائري على استخدام مصطلح "مشاتل المؤسّسات"، ومنحها طابعا قانونيّا جديدا حيث أصبحت هياكل محلّية تابعة للوكالة المذكورة، مهمّتها تنفيذ دعم المؤسّسات الصّغيرة والمتوسّطة محلّيا، وبعد صدور المرسوم التّنفيذي 20 – 254 المتضمّن إنشاء لجنة وطنيّة لمنح علامة "مؤسّسة ناشئة" و"مشروع مبتكر" و"حاضنة أعمال"، ونظرا للتّقارب الكبير في الأدوار بين "مشاتل المؤسّسات" و "حاضنات الأعمال"؛ ذهب البعض للقول بأنّ المشرّع قد تخلّى عن المصطلح الأوّل واستبدله بمصطلح "حاضنات الأعمال" - الذي كان يستخدم مصطلحات قريبة منه حتّى قبل صدور المرسوم التّنفيذي 20 – 254 ، ك: "المحضنة" و"الحاضنة" - إلّا أنّ المشرّع استمر في استخدام مصطلح "المشاتل" في المرسوم التّنفيذي 20 – 331 المعدّل والمتمّم للمرسوم التّنفيذي 18 – 170- الذي تلاه في الصّدور- والبحث في ما إذا كانت "مشاتل المؤسّسات" و "حاضنات الأعمال" لهما الدّلالة نفسها لدى المشرّع الجزائريّ، أم أنّهما مصطلحين لمفهومين مختلفين هو سبب تقديم هذه الورقة البحثيّة. Pursuant to Executive Decree 170-18 specifying the tasks of the Agency for the Development of Small and Medium Enterprises and the Promotion of Innovation, repealing Executive Decree 78-03 containing the Basic Law for Enterprise Nurseries, the Algerian legislator maintained the use of the term "enterprise nurseries." Giving it a new legal character, as it became local structures affiliated with the aforementioned agency, whose mission is to implement support for small and medium enterprises locally, and after the issuance of Executive Decree 20-254, which included the establishment of a national committee to grant the mark of "start-up enterprise," "innovative project," and "business incubator." Due to the great convergence in roles between "enterprise nurseries" and "business incubators"; Some went on to say that the legislator had abandoned the first term and replaced it with the term "business incubators" - which he used terms close to even before the issuance of Executive Decree 20-254, such as: "incubator" and "incubator" - but the legislator continued to use the term "nurseries." In Executive Decree 20-331 amending and supplementing Executive Decree 18-170 - which was followed in the publication – Researching whether "enterprise nurseries" and "business incubators" have the same meaning to the Algerian legislator, or whether they are terms for two different concepts is the reason for submitting this research paper.
