الملخص

يعد المرسوم التنفيذي رقم 25-311 دعامة قانونية أساسية في تحيين آليات مرافقة الابتكار عبر تعديل وتتميم المرسوم رقم 20-254، حيث يهدف إلى إعادة صياغة المعايير القانونية لمنح علامة مؤسسة متسارعة مع تبسيط الإجراءات الإدارية المحفزة لتدفق الاستثمارات الناشئة. تبرز المستجدات القانونية لهذا النص في إقرار ضوابط أكثر مرونة لاستقطاب الهياكل الخاصة والعمومية، وتحديد التزامات دقيقة تتعلق بنوعية الخدمات المقدمة للمؤسسات الناشئة، بما يضمن فعالية البيئة المقاولاتية. كما يكرس المرسوم دوراً محورياً للجنة الوطنية لمنح العلامة في ظل التعديلات الجديدة، مساهماً في سد الثغرات الإجرائية السابقة، مما يمنح المؤسسة المتسارعة مركزاً قانونياً مستقراً يتيح لها الولوج الفعلي للتحفيزات الجبائية والمالية، انسجاماً مع استراتيجية التحول الرقمي الوطنية.Executive Decree No. 25-311 constitutes a significant regulatory instrument aimed at strengthening the legal framework governing innovation support mechanisms through the amendment and supplementation of Executive Decree No. 20-254. Its primary objective is to recalibrate the legal criteria for the granting of the “Startup Label,” while streamlining administrative procedures in order to foster investment inflows into emerging entrepreneurial ventures. The recent legal developments introduced by this regulatory framework establish more flexible compliance standards intended to enhance the attractiveness of both public and private institutional stakeholders. At the same time, the decree sets out more precise obligations concerning the quality and delivery of services provided to startups, thereby improving the operational efficiency and legal certainty of the entrepreneurial ecosystem. Moreover, the decree consolidates the strategic role of the National Committee responsible for awarding the label under the revised regulatory scheme, contributing to the mitigation of prior procedural shortcomings. This reform ultimately provides startups with a more stable and predictable legal environment, facilitating effective access to fiscal and financial incentives in alignment with the national digital transformation strategy.
