Abstract
في إطار توجه الدولة نحو دعم المبادرات الفردية وتشجيع الشباب على دخول عالم الأعمال في ظل بيئة عمل قانونية ومن ثم تطوير قطاع الاستيراد المصغر في الجزائر ،وفي سياق تطبيق نظام المقاول الذاتي والحد من التجارة غير الرسمية ، صدر المرسوم التنفيذي رقم 25-170يحدد شروط وكيفيات ممارسة نشاط الاستيراد المصغر من طرف المقاول الذاتي حيث يهدف إلى وضع إطار قانوني صارم وواضح لتنظيمه ، ويحدد بدقة المعايير المادية والمالية التي تُعرّف هذا النشاط، كما يفرض شروطًا إلزامية لممارسته، أبرزها التسجيل في سجل خاص لدى الجهات الإدارية المختصة. هذا الإجراء يضمن تتبع المعاملات وتعزيز الشفافية، ما يمنع تحول هذا النوع من الاستيراد إلى وسيلة للتهرب الضريبي أو المنافسة غير الشريفة، ويساهم في دمج النشاط ضمن الأطر الاقتصادية الرسمية. كما أنه لا ينظم الاستيراد فحسب، بل محاصرة التجارة غير الرسمية التي تستغل حالة غياب الأطر القانونية لتنمية أنشطتها، مما ينعكس سلبًا على الاقتصاد الوطني ويخلق منافسة غير عادلة للقطاعات الرسمية. As part of the State's orientation towards supporting individual initiatives and encouraging young people to enter the business world in a legal working environment and thus develop the small import sector in Algeria, and in the context of the implementation of Self-Contractor regime and the limitation of informal trade, executive Decree No. 25-170, was issued, defining the conditions and procedures for the exercise of by independent entrepreneurs. It aims to establish a strict and clear legal framework to regulate this activity and precisely defines the material and financial criteria that define it. It also imposes mandatory conditions for its exercise, including registration in a special register with the competent administrative authorities. This measure ensures the tracking of transactions and enhances transparency, preventing this type of import from becoming a means of tax evasion or unfair competition. It also contributes to integrating the activity within the formal economic framework. This has a negative impact on the national economy and creates unfair competition for formal sectors. Therefore, linking micro-import activity to clear legal conditions and regulatory procedures represents an essential step toward rationalizing the market
