The Legal Framework Of The Freezing Excess Fertilized Eggs Contract Under Algerian Legislation

Authors : Benlecheheb Asma .

Abstract

Freezing excess fertilized eggs in IVF is a major modern technique in the field of assisted reproduction technology as it offers the possibility for couples to preserve these eggs in optimal conditions for future use. The recourse to this technique led to the emergence of new legal relations between the freezing banks and the beneficiaries, and these relations are governed by special contracts, which are a mixture of medical, technical and contractual aspects. This study purports to define and describe the characteristics and legal nature of the fertilized-egg freezing contract, in addition to the resulting obligations for both parties. The results show a legislative vacuum in respect to this contract, which requires the intervention of the legislator to organize it in a special law frame as to achieve a balance between the financial rights of freezing centers and the respect of human dignity of the preserved eggs.
